Starmer Advocates for Immediate Implementation of Supreme Court Ruling on Single-Sex Spaces

Keir Starmer has made a strong call for public institutions to promptly enforce a recent Supreme Court decision which affects the inclusion of transgender individuals in single-sex spaces. This move follows a landmark verdict where the Supreme Court clarified that the legal interpretation of "sex" under the Equality Act 2010 pertains strictly to "biological sex," effectively excluding transgender people from protections under this definition.

In response to the ruling delivered in April, the Equality and Human Rights Commission (EHRC), which serves as the UK's equality watchdog, issued interim guidance. This guidance suggested that trans men and women should be barred from accessing spaces that align with their gender identity, as well as in some instances, spaces aligning with their "biological sex."

When probed during the NATO summit in The Hague about whether institutions like hospitals, universities, and governmental departments should align their internal protocols with the Supreme Court's ruling, Starmer, the Prime Minister, affirmed the need for compliance. He stated, “We’ve accepted and welcomed the ruling, and from my perspective, all subsequent actions should reflect that decision.”

With the consultation period on the EHRC guidance concluding today, there is an urgency expressed by Starmer for bodies to align their policies swiftly. Maya Forstater, the head of the gender-critical advocacy group Sex Matters, highlighted Starmer's statement as a significant intervention, aimed at ensuring public bodies adhere to the law. She emphasized the necessity of political leadership to prevent women from resorting to legal battles, which could pose a financial burden on taxpayers.

Anticipated to have extensive impacts on the transgender community, the Supreme Court's ruling has already prompted notable institutions such as the Scottish and UK parliaments, the Football Association, Financial Conduct Authority, and England and Wales Cricket Board to restrict access to single-sex spaces based on biological sex.

As the EHRC's public consultation on its Code of Conduct concludes, a mass lobby recently occurred at Westminster. During this event, transgender individuals sought to express their concerns to Members of Parliament regarding the proposed changes. Green Party co-leader Carla Denyer issued a cautionary note that the EHRC’s provisional guidance could serve as a "bigot’s charter," potentially inciting harassment and violence against transgender individuals in public spaces as they attempt to use facilities.

Starmer, who has previously faced criticism for changing his stance on transgender rights, reiterated his position following the Supreme Court judgement. Speaking to the BBC, he commended the decision for providing essential clarity, which he believes will facilitate the development of consistent guidance. Starmer stressed that the ruling has offered a clearer legal framework, enabling progress and ensuring that all guidance aligns with the judgement.

During an interview with ITV West Country, when asked if he still considered trans women to be women, Starmer deferred to the Supreme Court's definition, stating, “A woman is an adult female. The judgement is a welcome step forward, and we need to ensure that all guidance is appropriately aligned with this decision.”

In recent years, Labour's stance on transgender rights has evolved. In 2020, the party supported the introduction of self-identification for transgender individuals. However, by 2023, Labour had adjusted its approach to Gender Recognition Act reforms, maintaining the requirement for a medical diagnosis of gender dysphoria.

The Supreme Court case emerged from a dispute with the Scottish government, initiated by the group For Women Scotland with backing from author J.K. Rowling, challenging a lower court's interpretation that sex was not strictly biological.
