Senate parliamentarian removes gender-affirming care ban from GOP bill

In a pivotal move, a decision from our Senate parliamentarian just scrapped provisions that would've blocked federal funding from supporting gender-affirming care in a new Senate reconciliation bill. Announced on Tuesday, this decision essentially wipes out several health-related provisions from a bill that Senate Republicans had introduced.

The push from Republicans aimed at cutting off coverage through federal programs like Medicaid and CHIP specifically targeted transgender healthcare services. This contentious measure also made its appearance in a House version, which barely squeaked through on May 22 with a 215-214 vote.

How Medicaid provisions are affected

Beyond just gender-affirming care, this ruling also axed Republican plans that would've set up a new Medicaid provider tax structure. States would've had more leeway in taxing healthcare providers, with those funds aimed at boosting Medicaid. The decision also stopped broader Medicaid funding cuts that were on their agenda.

Republicans react post-ruling

Some Republicans called on lawmakers, including U.S. Rep. Greg Steube from Florida, urging colleagues not just accept this ruling quietly. However, GOP Senate Majority Leader John Thune from South Dakota advised against overriding it. "Forcing it through could jeopardize getting any bill passed," Thune mentioned, hinting at possible delays. Senate Republicans hoped they could wrap up this reconciliation bill by week-end, though they weren't locked in by any legal deadline.

The bill's financial stakes

Former President Donald Trump has hyped this legislation as his "one big, beautiful bill," aiming it at extending 2017's tax cuts that majorly favored wealthy individuals and corporations. To balance these tax cuts—estimated at more than $4 trillion over a decade—the bill proposes deep cuts in social welfare, especially Medicaid.

Democrats push back and voice worries

Eclipsed by Republican majorities, Democrats haven't had much room at negotiating table, but they haven't been silent. They've long criticized these efforts, pointing out GOP's attempts at stripping millions off healthcare in exchange tax cuts favoring wealthy. According CBO, proposed cuts would result in 10.9 million losing health coverage through Medicaid or ACA marketplaces.

On other side, some Republicans, like U.S. Senator Josh Hawley from Missouri, express worry over drastic Medicaid cuts, suggesting they could spell disaster constituents and health facilities—such as hospitals, nursing homes, and rural community providers.

Reaction from human rights advocates

In light parliamentarian's decision, Human Rights Campaign (HRC) released statement welcoming removal gender-affirming care ban but still standing firm against overall bill. David Stacy, HRC's VP government affairs, remarked, "This bill, regardless, deserves dumping. It proposes harmful healthcare cuts—Medicaid included—that unfairly hit LGBTQ+ community, just fund tax cuts wealthy."

Stacy added, "While we're relieved Senate parliamentarian ruled against one provision that would've denied vital healthcare transgender adults, our fight persists. Our community faces multiple threats, Supreme Court included, and we're committed defeating this bill all our might."
