The Long Island Roller Rebels, a well-known roller derby team, faced a significant setback this past Tuesday. Their legal attempt to temporarily halt Nassau County's ban on transgender athletes competing in female sports leagues was denied by the court.
In his ruling, Nassau County Supreme Court Judge Bruce Cozzens stated that the law, which was enacted last summer, does not explicitly prevent transgender women and girls from participating in public sports facilities according to their gender identity. He noted that transgender athletes still have the option to compete in coed leagues.
This ruling comes amidst ongoing controversy and legal battles regarding transgender athletes in Nassau County, a region located just east of New York City. The origins of the conflict trace back to February of the previous year, when Nassau County Executive Bruce Blakeman made an unprecedented move. He ordered the county's parks department to stop issuing permits for women’s and girls’ sports teams that included transgender athletes.
The justification given by Blakeman and his supporters is that transgender athletes allegedly possess inherent advantages. "These athletes have a competitive advantage," Blakeman claimed. "It’s unfair, and it’s also unsafe." This stance has been met with significant opposition from various civil rights organizations and community leaders.
New York Attorney General Letitia James responded swiftly to Blakeman's initial order by issuing a cease-and-desist letter. She condemned the action as discriminatory and warned that legal action would follow if the executive order was not rescinded. "Pernicious discrimination such as this is precisely what New York’s Human and Civil Rights Laws proscribe," James emphasized. Despite this warning, Blakeman chose to escalate the situation by filing a federal lawsuit. The lawsuit seeks judicial clarification on the legality of the ordinance, effectively delaying any repeal.
In May, a New York judge ruled that Blakeman had overstepped his authority with the initial ban, overturning the order. However, the Republican-controlled Nassau County Legislature quickly passed a local law to embed the ban into county regulations. This legislative action has led to the current legal challenges, including the case brought by the Roller Rebels.
The Roller Rebels, along with their legal representatives from the New York Civil Liberties Union, have been vocal in their opposition to the ban. Gabriella Larios, the team’s attorney, described the judge’s decision to deny the injunction as "an outlier." Meanwhile, Amanda “Curly Fry” Urena, president of the Roller Rebels, labeled the ruling as "transphobic."
“At a time of rising anti-LGBTQ+ hate and violence across the country, keeping this ban intact is not only cruel, but it is also dangerous,” Urena stated. The Roller Rebels hope that the courts will eventually nullify the ban, acknowledging its discriminatory nature.
This case continues to draw national attention as similar disputes unfold across the United States. Critics argue that such bans not only marginalize transgender individuals but undermine the very principles of diversity and inclusion that are central to community sports.
