Rutger published: Italian Court Rules in Favor of Legal Recognition for Lesbian Mothers

In a landmark decision, Italy's Constitutional Court has ruled in favor of lesbian couples, allowing both partners to be legally recognized as a child's mother. This significant ruling, delivered on Thursday, May 22, represents a pivotal step forward for LGBTQ+ rights in Italy, particularly for same-sex female couples seeking parental recognition.

The court's decision addresses the legal status of non-biological mothers in lesbian relationships where the couple has undergone in vitro fertilization (IVF) abroad. Prior to this ruling, only the biological mother could be recognized as a legal parent under Italian law, a restriction that has now been overturned by the Constitutional Court.

According to the court's findings, denying legal recognition to the non-biological parent in such cases violates several constitutional principles. Marilena Grassadonia, a prominent LGBTQ+ rights advocate and member of the Italian Left opposition party, hailed the decision as a "historic day" for Italy. She expressed that it "restores dignity and serenity to the many rainbow families who live in our country," acknowledging the struggles faced by same-sex couples seeking equal parental rights.

On the same day, a related ruling addressed the issue of single women accessing IVF treatment. Although the court found no constitutional violation in denying single women access to IVF, it left room for legislative change if driven by political support within parliament.

This legal victory comes at a time when LGBTQ+ rights in Italy are under significant pressure. In 2023, the government began removing the names of lesbian mothers from their children's birth certificates as part of a broader rollback on LGBTQ+ rights. Following the 2022 election victory, Prime Minister Giorgia Meloni's administration has indicated intentions to tighten restrictions on reproductive rights, including access to abortion, amidst accusations of homophobia and opposition to what she describes as "gender ideology."

The decision by Italy's Constitutional Court marks a momentous occasion for LGBTQ+ rights advocates and same-sex families across the country.
