Rutger published: Eight Officers Dismissed Following Alleged Cover-Up of Assault on Transgender Man

An Incident of "Contempt of Cop" Leads to Major Consequences

A case of "contempt of cop" involving a transgender man and Los Angeles County sheriff deputies has resulted in the dismissal of at least eight deputies. The incident, which took place in a 7-Eleven parking lot, involved the beating of 23-year-old Emmet Brock, a teacher, who was assaulted following a minor altercation with deputies.

According to reports, the Los Angeles County Sheriff's Department has been shaken by a federal investigation into the events surrounding Brock's beating. This investigation has uncovered a significant cover-up among deputies who sought to protect one of their colleagues, Deputy Joseph Benza III.

Federal Charges and Plea Agreement

Deputy Joseph Benza III has agreed to plead guilty to a federal felony count of deprivation of rights under the color of law. This charge carries a potential maximum prison sentence of 10 years. Benza's plea agreement follows revelations that he provided false information to the FBI about the incident, and that other deputies, including some in supervisory roles, participated in obstructing the investigation.

The Los Angeles County Sheriff's Department, in response to these allegations and the ongoing investigation, confirmed Benza's dismissal on December 18th. The following day, they acknowledged that multiple deputies had also been relieved of their duties, with sources indicating that a total of eight deputies were involved, including several sergeants.

In a statement, an LA County Sheriff's spokesperson expressed deep concern over the actions of those involved, emphasizing that such conduct undermines the department's integrity and the community's trust.

The Incident and Its Aftermath

The events leading to the investigation began in February 2023, when Emmet Brock, while driving past Deputy Benza, made an obscene gesture. Although Brock believed the gesture went unnoticed, Benza pursued him in a two-mile chase that culminated in the violent encounter at the convenience store parking lot. Surveillance footage captured the beating, which lasted for several minutes as Brock pleaded for his life.

Brock's lawyer, Thomas E. Beck, has filed a federal lawsuit against Los Angeles County, Deputy Benza, and several other deputies, citing false imprisonment, civil rights violations, and assault and battery. The lawsuit claims that Brock's rights were further violated during processing following his arrest, which included humiliating treatment.

Community Impact and Legal Proceedings

The assault and subsequent cover-up have stirred significant concern within the community, particularly given the broader context of police interactions with LGBTQ+ individuals. Data indicates that LGBTQ+ youth face higher levels of police harassment compared to their non-LGBTQ+ peers, underscoring the critical need for accountability and reform.

Sheriff Robert G. Luna has publicly condemned the actions of those involved, stating that such behavior is deeply troubling and a violation of the trust placed in law enforcement officers to uphold the law without prejudice or abuse of power.

Deputy Benza is scheduled to return to court in January to formally enter his plea. His attorney has indicated plans to request probation. Meanwhile, the U.S. Attorney's Office has described Benza's actions as a federal civil rights violation, emphasizing the excessive use of force against Brock as retaliation for exercising his First Amendment rights.

As Brock awaits resolution, he continues to move forward with his life, working at a homeless shelter and pursuing a master's degree at California State University. Despite the challenges he has faced, Brock remains focused on his future, expressing a degree of relief at the progress made in holding those responsible accountable.
