The United States Department of Education has initiated an investigation targeting the high school sports governing bodies in California and Minnesota. This move comes in response to a recent executive order by former President Donald Trump, which prohibits transgender women from participating in women's sports competitions.
Dubbed "Keeping Men Out of Women's Sports," the executive order fulfills a campaign promise made by Trump. Organizations such as GLAAD have criticized the order, arguing that it lacks any legitimate basis for protecting women and girls. The order specifically bans transgender women from competing in women’s sports, igniting widespread debate and controversy.
Following the signing of the executive order, the Department of Education now possesses the authority to examine high schools and sports governing bodies suspected of non-compliance with the order. Investigations under Title IX have begun against the California Interscholastic Federation and the Minnesota State High School League after these bodies announced their commitment to enabling transgender students to compete according to their affirmed gender identity, rather than their sex assigned at birth.
These organizations maintain that they are adhering to state anti-discrimination laws. However, a spokesperson for the Trump-Vance administration has asserted that the executive order takes precedence over state legislation.
On Wednesday (February 12), Craig Trainor, the acting assistant secretary for civil rights at the Department of Education, stated, "The Minnesota State High School League and the California Interscholastic Federation are free to engage in all the meaningless virtue-signaling that they want, but at the end of the day they must abide by federal law."
Title IX, a pivotal civil rights law enacted in 1972, explicitly prohibits sex-based discrimination in educational programs and activities receiving federal funding. While historically known for promoting gender equality in collegiate sports, the law's interpretation has become a contentious issue concerning transgender inclusion in sports.
In recent developments, the Biden administration sought to amend the legislation to explicitly protect LGBTQ+ students and prevent discrimination based on sexual orientation and gender identity. These proposed updates, initially suggested in 2022, have faced significant opposition from several Republican-led states. These states have vowed to oppose the changes, criticizing the Biden administration's updates as "illegal, undemocratic, and divorced from reality." The US Supreme Court, as of August 2024, ruled that the newer interpretations of Title IX cannot be enforced in 26 states where ongoing legal disputes continue.
Earlier this year, Republicans made an effort to redefine Title IX protections strictly in terms of biological sex within their proposed rules for the 119th Congress. This move further fueled the ongoing debate over the scope and application of Title IX in relation to transgender rights.
