Rutger published: Understanding the Implications of a Potential Constitutional Crisis

Since Donald Trump took office in 2017, we've seen a heated debate flare up among legal experts and political commentators. They're arguing over whether his time in office led us straight towards a "constitutional crisis." Opinions come from all over, with each bringing its own spin on what happened.

Even though President Trump and his team vowed those famous 35 words—to "preserve, protect, and defend" our Constitution—many claim there were some serious misses in that mission.

what's a constitutional crisis anyway?

To really dig in, we've got first check what a constitutional crisis even means. Political scientist John Cioffi describes it as a showdown over political power that could mess with or even wreck our government structure as set out by our Constitution. Using this lens, it seems like a good number actions from Trump and his crew raised some eyebrows:

  • Using emergency powers as a workaround, imposing tariffs without Congress, even though regulating commerce falls under their job description.
  • Canning federal staff and trying dismantle departments like USAID and Education, both born by congressional mandate.
  • Supposedly twisting War Powers Act, deporting undocumented people without a fair hearing, which flies in face habeas corpus.
  • Ignoring federal and Supreme Court orders on deportation matters.
  • Questionable dealings with gifts from foreign entities, raising flags on conflicts interest.
  • Claims monetizing White House access, including things like selling meme coins and giving out tour favors.
  • Targeting law firms and cutting research funds over policy disagreements.
  • Arresting a federal judge trying keep order in court.
  • Mixing personal business with state-funded trips abroad.

This isn't an exhaustive list, but it paints a picture about why folks are concerned about how this lines up with our constitutional framework.

the checks and balances dance

Our Constitution didn't just happen—it was built with checks and balances, so no branch runs away with power. But what happens when one branch skips its oversight duties or ignores another? The governance machine starts sputtering.

During Trump-era, Congress, with its Republican majority, sometimes hesitated on reining in Executive antics. Meanwhile, judges were busy issuing orders and injunctions—though occasionally these seemed brushed aside. Just take a look at how deportees remained in rough spots overseas despite Supreme Court saying otherwise.

trust, laws, and how public sees it all

These events have really chipped away at public trust in our legal system, casting doubt on whether our Constitution can handle executive overreach. When branches don't act as they should, or when rulings get ignored, keeping power in check isn't easy.

Now, some might argue if we're knee-deep in a "constitutional crisis," but there isn't much argument that these moves have pressured our nation at its core.

Whether you call it a "constitutional crisis" or not, what matters here are effects on how we see our government and its integrity. Keeping a close eye on constitutional values? That never goes out style.
