Prominent actress and activist TS Madison has voiced strong opposition to a recent executive order by President Trump, which she believes poses a severe threat to the rights and lives of transgender individuals. This order includes mandates that require transgender prisoners to be housed in facilities that match their sex assigned at birth, rather than their gender identity.
The executive order stipulates that the federal government will officially recognize only two genders—male and female—effectively dismissing the identities of many individuals within the transgender community. TS Madison, who is herself a transgender woman, expressed her dismay in a statement to TMZ, emphasizing the fundamental right of every person to self-identify. "You can put legal sanctions on anything, but you can never ever change anybody’s identity," she asserted. "You have the right to identify exactly however you choose to identify, always."
Madison, who gained fame through her reality show "The TS Madison Experience" and as a guest judge on "RuPaul’s Drag Race," stressed that the issue extends beyond the transgender community. "This isn’t just about trans people. It’s an attack on everybody," she continued. "Trump may think he can legislate our identities away, but that’s not how this works. We’ve always existed, and we’re not going anywhere."
The order's implications are particularly troubling for transgender inmates, who face heightened risks of violence when housed in facilities that do not correspond with their gender identity. Advocates have raised concerns that these policies will lead to an increase in violence against trans prisoners, as they will be placed in environments where they are exceedingly vulnerable. The order undermines previous protections under the Prison Rape Elimination Act (PREA) guidelines, which sought to prevent sexual violence against transgender prisoners.
Julie Abbate, an advocacy director at Just Detention International, a nonprofit organization dedicated to ending sexual abuse in prisons, described the executive order as "life-threatening." "It has immediate consequences to the actual lives and physical, sexual, and social well-being of any transgender person, including those who are locked up," she said. "People will die," Abbate warned, highlighting the dire outcomes such policies could have on trans inmates.
Statistics from the Vera Institute of Justice reveal the harsh realities faced by transgender individuals incarcerated in the prison system. A significant 31% of trans prisoners report feeling unsafe, with over half having endured sexual assault while incarcerated. Abbate's stark warning underlines the severity of the situation: "It’s unconscionable that the President of the United States has issued this order. It’s just unconscionable in its cruelty."
The executive order is not an isolated incident. In 2018, Trump similarly attempted to roll back protections for transgender prisoners, removing recommendations for housing trans individuals in accordance with their gender identity. This recent order, however, is more aggressive and binding, posing a greater challenge to legal advocates fighting for trans rights.
Adding to the controversy, Trump has made numerous claims that vilify the transgender community, falsely accusing political opponents such as Vice President Kamala Harris of supporting "transgender operations on illegal aliens in prison." Experts suggest that these orders disregard legal precedent and threaten to inflict significant harm before they can be legally contested.
The policy extends beyond the prison system, with directives for federal agencies to "remove all statements, policies, regulations, forms, communications, or other internal and external messages that promote or otherwise inculcate gender ideology." Additionally, it stipulates that federal funds "shall not be used to promote gender ideology," signaling a broad attempt to roll back trans rights in the U.S.
In the face of these challenges, activists like TS Madison remain steadfast in their efforts to resist such policies and fight for the rights and recognition of all transgender individuals. The battle for equality and dignity continues, as advocates work tirelessly to ensure that trans voices are heard and respected in the ongoing struggle for LGBTQ+ rights.
