In a significant move on his first day back in office, Donald Trump signed an executive order that reverses several of his predecessor's policies, including those that safeguarded transgender individuals' rights to serve in the military. Although the order does not immediately ban transgender people from military service, it sets the stage for a future prohibition.
The executive order, titled "Initial Rescissions of Harmful Executive Orders and Actions," accuses previous administration policies of being "deeply unpopular, inflationary, illegal, and radical." Among the rescinded measures is Executive Order 14004, which was initially enacted by Joe Biden to overturn Trump's earlier ban on transgender military personnel and to create inclusive policies for transitioning servicemembers.
Alongside the attack on transgender military members, Trump's order also dismantles other critical protections for LGBTQ+ individuals. Executive Order 14021, which sought to ensure educational environments free from discrimination based on sex, sexual orientation, or gender identity, is among the policies revoked. This order had required educational institutions receiving federal funds to adopt non-discriminatory practices benefitting LGBTQ+ students.
Moreover, Executive Order 14075, which aimed to advance equality for LGBTQ+ individuals by addressing conversion therapy and enhancing foster care protections, has also been rescinded. This order had directed federal departments to develop initiatives supporting LGBTQ+ families and protecting queer and trans students, particularly in response to various state-level legislative attacks.
In addition to these reversals, Trump’s new executive actions reassert a definition of sex based on reproductive biology at birth. This redefinition could deny transgender and nonbinary people the ability to obtain federal identification that aligns with their gender identity. It also impedes the enforcement of the Bostock v. Clayton County decision, which recognized that discrimination against LGBTQ+ individuals constitutes sex discrimination.
The response from LGBTQ+ advocacy groups has been swift and vocal. Kelley Robinson, President of the Human Rights Campaign, condemned the new administration's actions, stating, "Today’s expected executive actions targeting the LGBTQ+ community serve no other purpose than to hurt our families and our communities. Every person deserves to be treated with dignity and respect in all areas of their lives." Robinson emphasized the right to live free from discrimination, harassment, and humiliation in workplaces, schools, and healthcare environments.
Republicans have defended Trump's actions, with Representative Mike Rogers (R-AL) arguing that the rollback refocuses the military on its core mission by eliminating so-called "woke" diversity, equity, and inclusion initiatives. Trump has publicly stated his intention to reinstate a full ban on transgender military service, a move supported by his nominee for the Department of Defense, Pete Hegseth.
As the new administration takes shape, the LGBTQ+ community remains vigilant. Advocates are organizing and mobilizing to resist the rollback of rights and to push for inclusive policies that respect and uphold the dignity of all individuals, regardless of gender identity or sexual orientation.
