The Florida Highway Safety and Motor Vehicles (FHSMV) department quickly invalidated James's new license. They argued in a letter that changing from male was "improper" under state law, sticking strictly with their definition that "sex" must align with biological traits rather than personal identity.
Not only did they reissue James a license with their original gender marker, but they also launched an investigation. The possibility that James knowingly "made a false statement" about missing their old license could lead them facing harsh penalties such as license suspension or revocation.
This isn't happening in a vacuum. It's part and parcel with broader policies under Governor Ron DeSantis, who critics say has taken a hard line against LGBTQ+ rights. The situation became even tenser when DeSantis' press secretary, Jeremy Redfern, chose social media as a platform, misgendering James and fueling further divisions.

She pointed out how nearly 95,000 transgender adults in Florida are now facing additional burdens and disruptions as they attempt, legally, aligning their ID with their true identities.
Having incorrect documentation isn't just an inconvenience; it can lead directly discrimination or even violence by outing individuals as transgender, especially with refusals on issuing correct birth certificates. This makes navigating legal and daily life even more complex and risky.
With all that's happening, LGBTQ+ advocates and Democrats are appealing hard President Biden's administration. Their aim? Push back against what many see as "hate" and "confusion" perpetuated by Florida, urging federal protections against these state policies.
