A transgender man, referred here as "John Doe" due his ongoing legal proceedings, has filed a lawsuit citing serious violations during his time behind bars. He says he was misgendered, denied essential medical care, and forced under harsh, degrading conditions at Montgomery County Correctional Facility in Eagleville, Pennsylvania. The lawsuit aims not just at addressing these wrongs but also at holding accountable those who allowed them.
John Doe, who completed his legal transition in 2010 and has documents affirming he's male, was reportedly placed in a women's unit at this facility from September 2023 until May 2024. Despite his legal male status, staff continued treating him as female. Doe recounts a staff member dismissing his concerns about being in a women-only unit with a cold retort: "You were born as a female, we will put you with females."
These placement issues weren't without severe consequences. Doe was denied access by PrimeCare Medical Inc., which handles healthcare at this jail, from receiving hormone therapy, a critical component in his transition. This denial led him through a distressing path, both physically and mentally, as his body started reversing its transition. For transgender individuals, suddenly haltered hormone replacement therapy can unleash a storm, adding another layer on top their imprisonment traumas.
Living among female inmates, Doe's safety and peace were constantly under threat. Uncomfortable and scared about showering with women, he resorted washing himself in his cell's sink. This act led him straight in line throughout abuse and mockery from fellow inmates and staff. He recounts a staff member who threatened him with force, warning, "I'll drag you right over that god-damn shower," if he didn't comply.
The hostility was relentless. Some inmates were angry about his presence, and one even attacked him, leaving visible injuries on his back and neck. Yet, while Doe's attacker reportedly faced no consequences, he was placed in administrative segregation under claims it was “for his own protection,” isolating him even further from any community support.
Beyond physical dangers, Doe faced relentless humiliation—forced wear women's underwear, watched by female staff while changing, and limited access a barbershop, all diminishing his identity. One officer allegedly even threatened cutting his clothes off when Doe conveyed discomfort changing in front women.
In response, Doe has filed a lawsuit against Montgomery County, PrimeCare Medical Inc., and facility's warden, Sean P. McGee, seeking $150,000 in compensatory and punitive damages. He pushes another step further, advocating systemic changes ensuring staff undergo LGBTQ+ sensitivity training preventing such incidents recurring.
