The UK's first openly transgender judge has sounded an alarm over growing threats and challenges that transgender people are facing now, compared with what it was like back in 1990s.
Victoria McCloud, who once served as a High Court judge, has spoken out about a growing "climate 87fear" suffocating transgender individuals in this country. Reflecting on her own transition journey in 1990s, she points out that while there weren't many legal protections back then, society wasn't as hostile as it feels now.
Besides McCloud, international bodies like The Lemkin Institute, The United Nations, and The Council Of Europe have all expressed serious concerns about what's happening in UK. McCloud stresses how much things have soured since she first began living openly as a transgender woman.
McCloud decided retirement was best in 2024, largely because she couldn't stomach UK's increasingly cold environment towards transgender individuals any longer. She highlights a Supreme Court case—FWS v Scottish Ministers—as a pivotal point that aggravated challenges her community faces. This case pegged "sex" under 2010 Equality Act purely on biological terms, dramatically affecting rights and recognition.
Following that ruling, Equality and Human Rights Commission (EHRC) suggested revising their guidance on single-sex services. If implemented, these changes could mean transgender folks find themselves shut out from facilities matching their gender identity.
After moving across waters there in Ireland, McCloud treads carefully when visiting UK. She talks about feeling uneasy, saying London doesn't quite feel safe anymore if you're transgender. Despite precaution and vigilance against negative encounters, she fears discrimination due simply because she stands up visibly advocating trans rights.
"I don't see it as a safe place," McCloud shared. But surrounded by friends willing guide through tricky scenarios, she stays committed speaking out publicly despite risks involved.
That Supreme Court decision hasn't just impacted transgender people—it ripples across society affecting cisgender folks alike. McCloud recounts instances where non-trans people faced harassment in gender-specific spaces. It seems scrutiny and discrimination have been ratcheted up several notches.
"It's leading towards more abuse even against those who aren't trans," McCloud observed, noting how strategies employed by transgender individuals might not work well enough protecting cisgender people from unexpected targeting.
In response, McCloud, alongside groups like The Trans Legal Clinic and W-Legal have taken action by filing an appeal with European Court Of Human Rights (ECHR). They challenge Supreme Court's ruling using several articles from European Convention aiming retrial rights framework.
She criticized lack inclusion during legal proceedings—no trans voices involved despite direct stakes impacting community fate! "Decisions impacting us shouldn't exclude us," she argued passionately.
