In a recent move, Trump administration officials announced a new directive that will significantly impact public schools across America. They're rolling back a key policy from Biden's presidency that was intended as a safeguard against discrimination towards LGBTQ+ students under Title IX.
Back in June 2022, President Biden's Education Secretary, Miguel Cardona, clarified that Title IX, which initially aimed at preventing sex discrimination in schools taking federal funds, should also protect against discrimination based on sexual orientation and gender identity. This interpretation aligned with a major Supreme Court decision from 2020—Bostock v. Clayton County—that expanded Title VII protections in workplaces.
Fast forward, and we've got Trump's team stepping in with a new directive that completely flips Biden's interpretation on its head. Their executive order, touted as a championing "biological truth," defines only two sexes, male and female, as unchangeable and fundamental.
The Education Department's Office has described Trump's directive as a serious threat, branding it as a direct challenge that undermines Biden's Title IX widening. An official letter highlighted Trump's executive authority, noting that his stance takes precedence because he's at helm over his executive branch officers.
Supporting this shift, a January 2025 Kentucky court decision claimed Biden's Title IX interpretation was a stretch too far from what was originally intended, arguing it was unenforceable.
This directive isn't happening in a vacuum. It's part and parcel with efforts from Trump's earlier tenure aimed at undoing policies supporting transgender inclusion and anti-racist education. The threat looms large as schools risk losing federal funding if they back transgender students or push anti-racist teachings. Plus, there's now a requirement that schools inform potentially unsupportive parents about a transgender student's status. They've even accused supportive educators as engaging in “sexual exploitation” or “practicing medicine without a license.”
On top, Trump plans a comeback with policies from his first term that are bent on bolstering rights and protections not just toward sexual assault or harassment survivors, but also toward those accused, shifting some liabilities away from schools.
Emma Grasso Levine from Know Your IX raised alarm bells, calling it a distressing turn that abandons survivors, LGBTQ+ students, and others in dire need. She's calling on schools everywhere not just sit by but actively step up protections, given this thin federal guidance.
Within Education's walls, employees find themselves deep in a divisive battle over Diversity, Equity, and Inclusion (DEI). Some staff who were once encouraged by Trump back in his first term are now on leave, possibly because they participated in diversity training, reports NBC News.
