The Continuing Threats to Our Democracy: Resisting Complacency

The infamous phrase, “When the president does it, that means it is not illegal,” once spoken by Richard Nixon, has found a new life in the political playbook of Donald Trump. This sentiment, echoing from the past, resurfaces as Trump invokes a Nixonian defense to challenge charges of election interference, claiming presidential immunity as his shield.

Judge Tanya Chutkan, however, firmly rejected Trump’s motion on December 2, 2023. She emphasized that the U.S. presidency does not confer a “divine right of kings” to escape legal accountability. Her decision underscores the principle that former presidents are subject to the same laws as any other citizen, without special exemptions.

Yet, the debate over presidential immunity took a dramatic turn with the Supreme Court's 6-3 ruling in Trump v. United States on July 1, 2024. The decision granted broad immunity to presidents for actions deemed as exercising "core powers" of their office, though the specifics remain ambiguous. This ruling opens a Pandora’s box, suggesting that acts executed under the guise of "official capacity" may now evade legal scrutiny, a notion sharply criticized in Justice Sotomayor’s dissent.

In an unsettling scenario, the court pondered whether a sitting president could order military action against political adversaries. The implication that such acts could be protected under "official-acts immunity" poses a chilling threat to democratic checks and balances, effectively elevating the presidency to a status above the law.

Resisting Democratic Erosion

The preservation of democracy demands an informed, active citizenry. History shows that even under oppressive regimes, resistance movements emerge to defend the collective interest against authoritarian, oligarchic, and corrupt forces.
