In a recent legal development, Texas Attorney General Ken Paxton has initiated a lawsuit against Dr. Jason Jarin, a pediatric and adolescent gynecologist at the UT Southwestern Medical Center in Dallas. The lawsuit claims that Dr. Jarin violated state laws by not accurately reporting the sex assigned at birth of patients he treated, opting instead to document their gender identities.
Dr. Jarin is accused of incorrectly listing patients’ genders in medical records and using inappropriate billing codes to secure Medicaid and CHIP reimbursements for transgender youth receiving hormone therapy and puberty blockers. Notably, Texas law prohibits gender-affirming care for transgender minors, although similar treatments remain permissible for cisgender youth.
The lawsuit names the Children’s Health System of Texas as a defendant, due to Dr. Jarin's role as division director there. However, the health system has denied any wrongdoing. "Our highest priority is ensuring the health and well-being of the patients and families in our care," a spokesperson stated, asserting the organization’s compliance with all applicable healthcare regulations.
When approached for comment, Dr. Jarin declined to respond directly to the allegations but emphasized his commitment to patient care in past statements.
The complaint asserts that Dr. Jarin persisted in prescribing hormone therapy to transgender patients following the enactment of Texas’s ban on gender-affirming care on September 1, 2023. This continuation, the lawsuit claims, was intended to prevent patients from having to undergo forced detransitioning. The law permits ongoing hormone treatments for those who began therapy prior to the ban, but mandates a tapering off of dosages over a twelve-month period.
Among the claims, the lawsuit accuses Dr. Jarin of misrepresenting medical treatments for transgender youth as other medical issues. For instance, puberty blockers were allegedly coded as treatments for precocious puberty, and hormone therapies intended for gender transition were billed under unrelated medical codes.
The lawsuit identifies twelve anonymous transgender patients, alleging that Dr. Jarin recorded incorrect gender information in their medical claims. One example provided involves Patient Two, to whom Dr. Jarin prescribed testosterone, recognizing them as male. The suit disputes this, arguing the patient is "a biological female," which likely indicates a trans boy.
Texas law’s selective prohibition of gender-affirming care underscores the discriminatory nature of its enforcement; while treatments like hormone therapy and puberty blockers remain legal, their application is barred specifically for transgender youth. This discrepancy served as a focal point in previous legal challenges, highlighting potential violations of equal protection rights under U.S. constitutional law.
The emphasis of the lawsuit goes beyond billing issues, touching on ideological disputes concerning gender-affirming care. Paxton’s legal actions seem driven by an agenda to diminish support for such healthcare practices in Texas, emphasizing statements made by Dr. Jarin in support of gender-affirming treatments for youth.
"I will utilize every legal tool available to ensure that radical gender activists like Jarin are held accountable," Paxton declared. He described Jarin as a "criminal extremist" alleged to have harmed children and defrauded state-funded health programs.
Despite these allegations, numerous major medical associations, including the American Medical Association and the Endocrine Society, continue to endorse gender-affirming care for transgender youth while opposing legislative efforts to curtail such care.
This case marks the fourth time Paxton has pursued legal action against medical professionals for providing care to transgender minors in the state. As these legal battles unfold, they continue to shape the landscape of healthcare rights and access for LGBTQ+ communities.
