Rutger published: Sydney Duncan: A Beacon of Hope Amidst Challenges to Trans Rights

On the night of the 2024 election, Sydney Duncan, a seasoned advocate for LGBTQ+ rights and an attorney, was caught off guard. Duncan, who has long championed the rights of LGBTQ+ individuals, particularly in her home state of Alabama, was stunned by the election results. Despite the differences between the two presidential candidates, many voters sided with Donald Trump, marking the first time a Republican has claimed both the popular vote and the Electoral College since 2004.

Trump, now the President-elect, carries a controversial legacy, having been impeached twice and convicted of multiple felonies during his prior administration. Yet, it was his fierce opposition to trans rights during his campaign that Duncan found most troubling. The GOP reportedly invested over $222 million in ads targeting the transgender community, highlighting their agenda to restrict rights and access to essential care for trans minors. Prominent among their promises was the pursuit of a nationwide ban on gender-affirming medical care for trans youth and limiting the participation of trans athletes in sports.

"The reality is harsh," Duncan shared, reflecting on the election outcome, "but we have to face it. Seeing Trump back in power, especially with his stance on trans rights, is like a recurring bad dream." As the senior counsel for Advocates for Trans Equality (A4TE), Duncan is acutely aware of the ripple effects such policies can have, especially in states like Alabama, which already enforces some of the strictest laws against trans youth health care.

Preparing for the Road Ahead

A4TE, formed in June 2023 through the merging of the National Center for Trans Equality and the Trans Legal Defense and Education Fund, stands as a formidable force in the ongoing battle for trans rights. The organization leverages legal expertise and advocacy to bolster trans political representation and rights at a critical juncture.

Duncan notes that the trans community is bracing for a wave of challenges. "We expect Trump to act quickly, likely by restricting federal funds for gender-affirming care," she warns. Such measures could mirror historic policies like the Hyde Amendment, cutting off essential healthcare access for many. This potential move echoes recent legislative setbacks, including a defense bill that restricted healthcare coverage for trans youth under TRICARE.

Strategic Advocacy and Legal Battles

Duncan and her team at A4TE are also preparing for a crucial Supreme Court case, U.S. v. Skrmetti, which could set a precedent for state-level restrictions on trans medical care. "The outcome of this case could empower states to impose even harsher laws," she explains. "However, a favorable ruling would necessitate a more rigorous justification for such legislation, not just a blanket opposition to trans people."

Amid the legal and political turbulence, Duncan emphasizes the importance of visibility and representation. She draws parallels to key moments in LGBTQ+ history, suggesting that a significant cultural shift could help dismantle prejudice and misunderstanding against trans individuals.

Unwavering Resilience in the Face of Adversity

Despite the daunting challenges, Duncan remains optimistic. Her experiences in Alabama, where she has often confronted anti-trans policies head-on, have fortified her resolve. "Every day, I witness the trans community living authentically," says Duncan. "Their resilience and courage are inspiring. We will not be silenced or deterred."

For Duncan, the fight for trans rights is not just a legal battle but a deeply personal one. She believes in the inevitability of trans liberation and vows to continue advocating until equality is achieved. "The path may be long, but the spirit of the trans community is unbreakable," she affirms. "We're here to stay, and our voices will only grow louder."
