Rutger published: Survivor Confronts Attacker: Justice Served in Manhattan Rape Case

In a story that truly shows what justice can look like, Siobhan Ebert, a transgender woman from Manhattan, stood face-to-face with her attacker more than a year after a horrifying incident. In a courtroom that must have felt both intimidating and liberating, she confronted Nicholas Encarnacion, her neighbor and assailant, and began turning a painful page in her life story.

A long-awaited encounter

It all began back in October 2022. Ebert and Encarnacion lived in an apartment building on Manhattan's Lower East Side. After a fun night out with friends and her fiancé, Ebert found herself in an elevator meeting she won't soon forget. It was around 10:30 p.m. when Encarnacion approached her near those familiar doors.

In court, Ebert recounted how Encarnacion followed her inside, blocking her escape. Despite her firm rejections and mentioning her fiancé nearby, he continued with unwanted advances, quickly turning a normal night sour with fear.

A nightmarish encounter

Ebert described in vivid detail how Encarnacion forcibly kissed and groped her in that small space. She managed a desperate escape when doors opened, but Encarnacion wasn't done. He pursued her across hallways and stairs, where he violently attacked her, leaving both physical and emotional scars.

After this horrific ordeal, Ebert needed medical attention, and fortunately, police captured Encarnacion that same night.

Standing strong against adversity

When it came time in court, Ebert stood strong, expressing what this crime had cost her. She shared her story with admirable strength, turning her pain invisible words. Directly addressing Encarnacion, Ebert didn't hold back her emotions.

"I hate you. You ruined my life," she declared, filling that courtroom with raw honesty. Her words were powerful, echoing what so many feel but might not be able or ready yet, reminding everyone present about both violence's dark shadow and survivor's bright resilience.

Justice and a step forward

Judge Kathryn Paek sentenced Encarnacion as he deserved—to 12 years in a New York state prison. This gave Ebert some justice and relief. Manhattan District Attorney Alvin Bragg praised Ebert's bravery, emphasizing how essential her voice was in holding Encarnacion accountable.

"This victim's night out ended in horror, but she faced him and spoke her truth," DA Bragg said, understanding Ebert's ongoing struggle but hoping she finds peace and recovery from it all.

This case isn't just one woman's story—it's about how survivor testimony can change outcomes and why we must keep fighting until safety and respect are norms rather than aspirations, especially within transgender communities like Ebert's.
