The Supreme Court has reinstated the legislative voting rights of Republican Maine state lawmaker Laurel Libby. She had previously been stripped of these rights by Democratic legislative leaders following her controversial attack on a transgender minor in a social media post. The post included before-and-after transition pictures, deadnamed the student, and misgendered her.
The court issued its decision in a brief, unsigned order that did not explain its reasoning, according to reports from major news outlets. Liberal Justices Sonia Sotomayor and Ketanji Brown Jackson both dissented. Justice Jackson expressed concern that the court's decision was an unnecessary interference, particularly since there are no upcoming legislative votes in Maine that would have been affected by Libby’s exclusion from voting.
Libby’s social media post quickly gained traction on right-wing media platforms, but it also drew significant criticism for targeting a minor to make a political point. Maine state House Speaker Ryan Fecteau, who is openly gay, requested that Libby take down the post, but she refused.
As a result of her actions, the Maine House of Representatives passed a resolution censuring Libby by a 75-70 party-line vote. The resolution condemned her post as "reprehensible" and "incompatible with her duty and responsibilities as a member of the House." It barred her from speaking or voting on the state House floor, although it allowed for her privileges to be restored if she issued an apology.
Libby refused to apologize and instead filed a lawsuit, arguing that the censure violated her First Amendment rights and those of her constituents. U.S. District Court Judge Melissa DuBose ruled against her on April 22, as did the 1st Circuit Court of Appeals. Subsequently, Libby appealed to the U.S. Supreme Court for intervention.
A cisgender student athlete, who had lost a track event to a transgender competitor that Libby criticized on television, wrote a public letter denouncing Libby’s actions as "ugly" and "hateful," noting that they marred an otherwise joyful day of competition.
In her dissent, Justice Jackson criticized the Supreme Court's emergency intervention as "both inequitable and unwise." She highlighted that historically, the court granted injunctive relief only in "the most critical and exigent circumstances." Jackson pointed out that there were no significant legislative votes pending in which Libby's participation would affect the outcome, nor did Libby demonstrate any concrete, imminent, and significant harm.
Justice Jackson further criticized the court for opting "to dole out error correction as it sees fit," rather than proceeding with caution. This decision by the Supreme Court follows a recent ruling allowing the president to expel transgender individuals from the military, despite lower courts finding the policy discriminatory and not beneficial to military performance.
