Rutger published: Sarah McBride Highlights Biological Oversight in Trump's Gender Policy

United States Representative Sarah McBride has brought attention to a critical oversight in a recent executive order issued by former President Donald Trump. This particular order, aimed at defining gender recognition, states that the United States government will acknowledge only two genders: male and female, as indicated on government-issued identification.

This executive action specifies a definition where a female is identified as “a person belonging, at conception, to the sex that produces the large reproductive cell.” Conversely, a male is described as “a person belonging, at conception, to the sex that produces the small reproductive cell.”

Biological Realities

However, there is a foundational biological reality that appears to have been overlooked. In human embryonic development, all embryos initially follow a "female" developmental pattern. It is only upon activation of the SRY gene several weeks post-conception that sexual differentiation begins.

Embryos with the XY chromosome set will start developing traits associated with male biology, tied to the Y chromosome, at approximately six weeks. Prior to this developmental stage, all embryos exhibit female phenotypic traits linked to the X chromosome. Indeed, as noted by the National Library of Medicine, genitalia at conception are "phenotypically female."

McBride's Insight

Sarah McBride, who made history as the first openly transgender congresswoman, humorously pointed out in a conversation with The Independent that the executive order effectively categorized everyone as female from the moment of conception based on its criteria. This unintended implication highlights a significant oversight in the executive order's language.

In his inaugural address, Trump emphasized the binary view of gender, affirming the existence of only "male and female" and expressing his intention to terminate governmental endeavors to impose racial and gender considerations across both public and private sectors.

Broader Implications

This executive order is one of several controversial measures taken by Trump early in his administration. Other actions include the abolition of diversity, equity, and inclusion initiatives, the cessation of birthright citizenship—a policy that guarantees U.S. citizenship to anyone born on American soil—the withdrawal of the United States from the World Health Organization, and the issuance of pardons for individuals convicted in connection with events on January 6, 2021.

The ramifications of such policies are broad and impactful, particularly for marginalized communities, including the LGBTQ+ community, which finds itself at the center of ongoing debates about gender identity and expression.
