He's currently under investigation by Washington, D.C.'s U.S. Attorney's office. This inquiry, led by Ed Martin, a Trump-appointed interim U.S. Attorney, questions if Garcia's recent comments about Elon Musk could be seen as threatening a public figure.
Speaking openly with Tim Miller, Garcia dismissed these allegations as "utterly absurd." He criticized this investigation as an attempt at intimidation, simply because he used a metaphorical jab at Musk, who happens, notably, been linked with Trump.
The whole drama kicked off after Garcia appeared on CNN on February 12. While discussing strategies against Musk, he remarked, "What Americans want from us are real weapons in this bar fight. This isn't just a fight; it's a fightfor democracy." Martin's letter pointed out this comment, suggesting it might be perceived as a threat.

Senior Democrat Rep. Gerald Connolly, also on Oversight, slammed this inquiry as a "deplorable attempt" at muffling Congress's oversight function. He accused Martin using Justice Department as a political vendetta tool.
Garcia's probe falls under a broader effort dubbed "Operation Whirlwind," which Martin's pushing as a means against public official threats. Critics argue it suppresses dissent, citing Martin's questionable decisions like dismissing January 6 riot cases while targeting political foes.

As Garcia faces a deadline on Martin's letter, he's not backing down. "Staying silent isn't an option," he emphasized, highlighting free expression as a core democratic value.
Reaffirming his viewpoint on CNN, Garcia stressed his use metaphorical language and need allowing open dialog. "This fight's about democracy," he said. "We should speak freely and certainly use figures speech."
