Rutger published: Puerto Rican Governor Enacts Gender-Affirming Care Ban for Trans Youth Under 21

In a decision that's stirring quite a controversy, Puerto Rico's Governor, Jenniffer González-Colón, has put a stop on gender-affirming care like surgeries and hormone therapy under a new law. This measure targets transgender youth under 21, even though it's pretty rare that minors undergo such surgeries.

Now, doctors who provide this kind care face some harsh penalties - we're talking up 15 years in prison, hefty fines reaching $50,000, and possibly losing their medical licenses. Not surprisingly, LGBTQ+ groups and healthcare professionals are up in arms, stressing just how vital this care really.

Protecting or overstepping?

The law claims it's all about safeguarding minors, suggesting they aren't mature enough yet make such big decisions with permanent consequences. The idea? The State has a duty ensure their well-being. But many doctors and advocates argue otherwise, saying it crosses line and violates transgender youth and their families' rights.

Groups like Puerto Rico's Federación LGBTQ+ and GLAAD aren't holding back in their criticism. They insist that everyone in Puerto Rico deserves access essential healthcare, free from discrimination. "By banning this care and denying parents right make informed decisions, this law places heavy burdens on marginalized communities," they argue.

The unique challenges in Puerto Rico

Transgender kids in Puerto Rico face some distinct hurdles, ones that differ from those mainland U.S. Over there, traveling might be option. But here, young people are kind stranded due geography. GLAAD points out, "Without access care, Puerto Rican trans youth have few options unless they can afford seek alternatives."

The ACLU in Puerto Rico isn't staying silent either. Executive Director Annette Martínez Orabona slams law, saying it divides children based on gender identity and sex assigned birth, complicating parental rights and healthcare equality.

Legal battles brewing

In response, Federación LGBTQ+ gearing up challenge law in court. Justin Jesús Santiago, their director, promises, "We're taking legal action against governor's law, which unjustly targets health professionals helping trans minors."

Santiago also warns that this legislation could increase suicide risks among trans youth, putting them in more vulnerable positions. Pedro Julio Serrano, president Federación LGBTQ+, didn't mince words either, calling Governor González-Colón "the most anti-equity governor in history" after she signed it, slamming her disregard medical advice supportive treatments trans minors.

Puerto Rico's law isn't alone; it's part a larger pattern, with several states enacting similar bans gender-affirming care trans youth. As debate rages on over these restrictions, advocates remain committed standing up trans youth rights.
