The state of Tennessee has a documented history of political discrimination against its 225,000 LGBTQ citizens. For instance, in 2019, a district attorney asserted that gay individuals should not be eligible for domestic violence protections. More recently, in 2023, for a period of five months in Murfreesboro, public homosexual acts were deemed illegal, a stance that was overturned following a federal judge's intervention.
During my brief stay in Tennessee in 2022, I had the opportunity to engage with the Nashville Grizzlies, a rugby team that prides itself on inclusivity. The members welcomed me warmly as an ally, demonstrating that rugby transcends the win-loss dichotomy, offering instead a safe and welcoming space for all to partake.
The challenge of feeling accepted in Tennessee is palpable, especially when considering that 87% of the LGBTQ community there has encountered workplace discrimination. Each year, numerous legislative proposals are introduced that specifically target their identities. Against this backdrop, the Nashville Grizzlies play rugby with a spirit reminiscent of a newfound freedom, embodying authenticity and camaraderie that was profoundly inspiring.
Upon learning about the passage of the "Charlie Kirk Act," I felt compelled to express my concerns regarding its implications.
Though presented as a measure to bolster free speech and promote public discourse on campuses, the legislation could effectively permit educational institutions to expel students who choose to walk out on speakers expressing hateful or harmful views. This places marginalized students in a position where they must endure rhetoric that could be existentially damaging.
This legislation also reveals an apparent contradiction in its approach to free speech. Last year, a Tennessee University administrator faced job termination for expressing negative opinions about Charlie Kirk. Additionally, numerous LGBTQ books have faced bans, not only within educational settings but also in libraries serving adult populations.
It's a common belief that progress is a natural outcome of moving forward in time, but current events suggest otherwise. A recent study conducted in 2023 found that 27% of LGBTQ individuals in Tennessee and 43% of the state's transgender population have considered relocating, prompting difficult decisions about leaving their homes in search of better prospects elsewhere. Ethan Thatcher, Captain of the Nashville Grizzlies, shared his perspective: "I've contemplated leaving Tennessee. It's challenging not to, given the government's stance. What keeps me here is the Grizzlies community and the idea that simply existing is an act of resistance."
Every person in our nation should have the right to feel secure in their environment. This principle is often viewed as fundamental to the American ethos. However, it appears that some states continue to extend hospitality and acceptance unevenly across different groups.
It's imperative that Tennessee's leadership, including Governor Bill Lee, take action to ensure that proposed laws like the "Charlie Kirk Act" do not further marginalize individuals or communities that are already vulnerable.
As a society, we must strive to uphold values of inclusivity and support, fostering environments where everyone, regardless of their identity, feels they belong.
Tyler Kania, a 2025 IAN Book of the Year nominee and civil rights advocate based in Columbia, Conn., shares this perspective with the hope that it will inspire thoughtful discourse and meaningful change.
