In a surprising turn of events, Secretary of State Marco Rubio has announced that all applications for passports with the "X" gender marker will be halted. This decision affects those who do not identify strictly as male or female and was an option introduced during the Biden administration. The decision was communicated through an internal State Department cable, which revealed that the new policy asserts "that an individual’s sex is not changeable." This marks a significant shift from previous policies that embraced a broader understanding of gender identity.
According to Rubio's email, "Sex, and not gender, shall be used" for all official documents, including passports. The directive is clear in its instructions to "suspend any application requesting an X sex marker" and to "suspend any application where the applicant is seeking to change their sex marker." This effectively reverses the inclusive measures that had been put in place to accommodate non-binary and transgender individuals.
This policy change is part of a broader move within the government, influenced by a recent executive order from former President Donald Trump. The order, titled Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government, insists on the recognition of only two sexes, determined biologically.
The executive order demands that all federal departments and agencies remove any material "that promote or otherwise inculcate gender ideology." It further dictates that "Federal funds shall not be used to promote gender ideology," and instructs the Bureau of Prisons to adjust its policies to prevent federal inmates from receiving treatments for gender transition.
The order argues that "Efforts to eradicate the biological reality of sex fundamentally attack women by depriving them of their dignity, safety, and well-being." It claims that ignoring biological sex in policy and language can undermine the structure of the American system.
The Biden administration had been progressive in its approach, having started to issue "X" gender marker passports shortly after President Joe Biden took office. At the time, Jessica Stern, the Special Diplomatic Envoy for LGBTQ Rights, stated, "When a person obtains identity documents that reflect their true identity, they live with greater dignity and respect." She emphasized that offering a third gender marker was crucial for reflecting the diversity of gender identity, gender expression, and sex characteristics.
Former Secretary of State Anthony Blinken had also made strides to simplify the process for transgender individuals to amend their passport’s gender marker by removing the need for medical certification of one’s gender identity.
Despite recent developments, there is still a commitment to dialogue with the LGBTQI+ community. "We also value our continued engagement with the LGBTQI+ community, which will inform our approach and positions moving forward," said Blinken at the time. The current administration has clarified that existing passports will not be invalidated by the new order. However, they must align with a person's "God-given sex, which was decided at birth" upon renewal.
