Rutger published: Nonbinary Passenger Challenges Airline Over Gender-Neutral Title Availability

A nonbinary traveler has initiated legal action against the European carrier Ryanair, claiming the airline discriminated by failing to offer gender-neutral titles during flight bookings.

The individual, whose identity remains undisclosed, encountered this issue while attempting to book a return flight from Gran Canaria to Germany in October 2021. Facing a limited set of options, they could only select from Herr (Mr.), Frau (Mrs.), or Fräulein (Ms.), none of which aligned with their gender identity.

Legal Grounds for the Lawsuit

The lawsuit, filed in July 2023, accuses Ryanair of violating Germany's General Equal Treatment Act, which seeks to ensure non-discrimination. The plaintiff is pursuing $5,400 in damages and demands that Ryanair update its booking systems to accommodate gender-neutral titles, making travel more inclusive for nonbinary individuals.

The case is progressing to a Berlin state court after Ryanair declined an out-of-court settlement, highlighting the persistent challenges faced by nonbinary travelers in achieving recognition and respect in various aspects of life, including something as routine as booking a flight.

Industry-Wide Moves towards Inclusivity

In 2019, the International Air Transport Association (IATA) provided guidance urging airlines worldwide to incorporate nonbinary title options. Following this, several airlines have made significant strides in adopting inclusive measures.

United Airlines became the pioneer among U.S. airlines to offer a nonbinary option, and major carriers like British Airways, Virgin Atlantic, Delta, and American Airlines soon followed suit. These airlines now allow passengers to choose ‘Mx’ as a title and offer gender markers such as ‘X’ for unspecified and ‘U’ for undisclosed.

Further demonstrating inclusivity, Virgin Atlantic abolished its gendered uniform policy in 2022 as part of its "Be Yourself" initiative. British Airways made headlines by permitting male crew members to wear makeup and carry handbags, underscoring the airline’s commitment to embracing individuality.

Impact of Inclusive Policies

The introduction of such policies has had a positive impact not only on staff but also on customer satisfaction. A Virgin press release highlighted a study showing staff mental well-being improved by 49% when they were allowed to express their individuality. Customer experience saw a 24% improvement, while staff happiness increased by 65%. Such statistics underscore the profound impact of inclusive practices on both employees and customers.

Lufthansa, another prominent airline, has replaced traditional greetings like ‘ladies and gentlemen’ with gender-neutral salutations such as "Dear guests" and "Welcome aboard," reflecting a broader shift towards inclusivity in the aviation industry.

Challenges and Setbacks

Despite these advancements, challenges remain. In the U.S., the State Department has ceased issuing passports that accurately reflect the gender identities of transgender, nonbinary, and intersex individuals, following federal directives that recognize only binary gender designations.

This policy reversal has sparked significant concern and backlash from LGBTQ+ advocacy groups, who argue that such measures undermine the rights and recognition of nonbinary and transgender individuals.

As the legal battle unfolds in Berlin, the outcome may set a precedent not only for Ryanair but for the entire airline industry. The case highlights the ongoing struggle for nonbinary recognition and the necessity for inclusive policies in all sectors.

The growing demand for nonbinary and inclusive options in travel and beyond signifies a cultural shift towards recognizing and validating diverse gender identities.
