Representative Nancy Mace, a Republican from South Carolina, is scheduled to address the Delaware GOP this week, bringing her advocacy for restricting transgender individuals from using bathrooms that correspond with their gender identity to the forefront. This event is set to take place in Delaware, the home state of Representative Sarah McBride, a prominent transgender lawmaker who has been a target of Mace’s criticism since McBride’s electoral win in November.

The gathering, organized in Newark, Delaware, is specifically designed to honor Mace, whom the now-removed event announcement praised as "one of Congress’s boldest conservative voices." While the event has been on the calendar since mid-December, it was recently reported by Axios that Mace’s speech will focus heavily on her advocacy for bathroom bans.

Controversial Legislative Push

Mace’s spokesperson, Syndey Long, confirmed that the congresswoman will discuss her efforts to implement these bathroom restrictions, along with "other key women’s issues," one of which includes her proposed Preventing Violence Against Women by Illegal Aliens Act. This legislative push has thrust Mace into the national spotlight, particularly due to her outspoken stance against McBride, who made history as the first openly transgender person elected to Congress.

Not content with merely proposing legislation, Mace has been actively vocal on social media and in media appearances, perpetuating anti-transgender rhetoric. Her resolution, aimed at barring McBride from utilizing women’s facilities at the Capitol complex, has been met with criticism from numerous quarters.

McBride’s Response

As Mace prepares for her engagement in Delaware, Rep. McBride will be attending a different event in Williamsburg, Virginia. Hosted by the Congressional Research Office, this bipartisan gathering will focus on seeking solutions to significant issues affecting constituents. Michaela Kurinsky-Malos, a spokesperson for McBride, stated, "This weekend Congresswoman McBride will attend a bipartisan meeting with her colleagues from the House to discuss solutions to the most pressing issues facing her constituents."

Implications for Transgender Staff and Visitors

The Capitol has seen transgender employees and visitors for decades without any reported incidents. McBride herself has access to a private restroom in her office, yet the proposed rule by Mace primarily threatens the accessibility and comfort of trans staffers and visitors at the Capitol. By introducing a measure that ties access to gendered facilities at the Capitol to a definition based on "biological sex," Mace’s proposal raises questions about its enforcement and the broader implications for inclusivity.

While the House’s new rule package did not pass a specific restriction on restroom usage, the policy was discreetly included in the Congressional Record's January 3 edition. This administrative maneuver, carried out under Speaker Mike Johnson’s authority, bypassed the usual process of House voting, sparking further controversy.

Responses from Advocacy Groups

Critics, including the Human Rights Campaign’s President Kelley Robinson, have condemned the policy as a discriminatory act that diverts attention from substantive legislative needs. Robinson stated, “This cruel and discriminatory policy has nothing to do with helping the American people or addressing their priorities; it’s all about hurting people.” Robinson added that it targets not only McBride but also all transgender and nonbinary people who work and visit the Capitol. "Speaker Johnson has proven yet again that the Republican majority is more focused on culture wars than on the needs of the country," Robinson remarked.
