Rutger published: LGBTQ+ Advocate Takes Legal Action Against Defamation

José Rolón, a devoted single parent and prominent advocate known for his work in celebrating LGBTQ+ family life, is courageously standing up against a barrage of damaging accusations.

Rolón, who shares his experiences as a gay father through his popular online presence as @nycgaydad, recently became the target of inflammatory comments by a notorious right-wing commentator, Stew Peters. Peters is known for promoting far-right extremist views, frequently targeting LGBTQ+ communities and other marginalized groups with hateful rhetoric.

Facing Down False Allegations

The situation escalated when Peters, using his substantial following that spans over a million people on various social media platforms, made false and harmful claims about Rolón. He accused Rolón of heinous acts against his own children, calling for extreme punitive measures without any basis in truth. "Some pervert homo has access to at least four kids around the clock..." Peters declared, further inciting his followers with outrageous and unfounded accusations.

Rolón, a father of three, found himself at a crossroads — either allow the malicious comments to stand unchallenged or expose the baseless nature of these accusations. Opting for the latter, Rolón courageously shared the defamatory statements to highlight the real-world impact of such dangerous rhetoric.

A Legal Battle for Justice

In a resolute move to defend his family and reputation, Rolón has filed a defamation lawsuit against Peters. The lawsuit, which details multiple counts of bias-related intimidation under New York civil rights law, seeks to hold Peters accountable for his actions. "Peters stirs up user engagement across his platforms by convincing his followers that Christian Americans are under attack by Jews, the LGBTQ+ community, and other marginalized groups," the lawsuit states, illuminating the precarious tactics used to incite hostility.

Notably, before proceeding with legal action, Rolón's legal team issued a cease-and-desist letter to Peters, demanding the removal of all defamatory content. Surprisingly, Peters complied, a small victory amidst the ongoing struggle.

Community and Legal Support

As Rolón prepares to bring his case to court, he is supported by a team of dedicated legal professionals who recognize the broader implications of such targeted harassment. "The sort of harassment and incitement my client and his young family suffered may be celebrated online, but a Brooklyn jury will look at it very, very differently," said Carrie Goldberg, one of Rolón’s attorneys.

Goldberg emphasized the responsibility that comes with having a large audience. "Our country has fought hard for First Amendment protections. But free speech never extends to inciting people to harass private citizens and make hoax police reports against them," she explained, highlighting the fine line between free expression and harmful incitement.

The Broader Impact

This case is more than just seeking justice for one family — it’s about setting a precedent in the digital age, where words can carry far-reaching and sometimes devastating consequences. Rolón’s story is a powerful reminder of the need for vigilance and accountability in combating online hate and misinformation.

By standing up to defamation and intimidation, Rolón is not only defending his family but also advocating for the safety and dignity of all individuals targeted by such vitriol.

A United Front

Community leaders and advocates have rallied in support of Rolón, recognizing his bravery and the vital importance of challenging baseless and damaging attacks. The outcome of this lawsuit could have significant implications for online conduct and the protection of marginalized communities.

Rolón's decision to take legal action sends a clear message: that such behavior will not go unchecked, and that those who traffic in hate speech and defamation will be held accountable for their words.

In a world increasingly interconnected by digital communication, Rolón’s stand is a beacon of resistance against hate and a call to action for justice and truth.
