New law aims at stopping discrimination against LGBTQ+ foster youth
A groundbreaking new effort has kicked off, aiming at ensuring LGBTQ+ individuals are treated fairly in foster care and adoption. Senator Kirsten Gillibrand from New York and Representative Angie Craig from Minnesota are at its helm, introducing a bill known as John Lewis Every Child Deserves a Family Act (ECDFA). This game-changer looks at putting real protections in place against discrimination faced by LGBTQ+ foster youth and prospective adoptive LGBTQ+ parents.
This proposed law makes it clear: any child welfare agency that gets federal money can't discriminate. It goes a step further by banning conversion therapy, which they recognize as harmful and coercive, targeting LGBTQ+ foster kids.
Creating a national resource center and improving data collection
The ECDFA isn't just about fighting discrimination. It also plans on setting up a National Resource Center dedicated specifically toward ensuring safety and stability and addressing well-being and permanency issues among LGBTQ+ kids in child welfare. Additionally, there's a push in this bill towards gathering more detailed data about LGBTQ+ youth in foster care, which can shed light on discrimination and help enforce accountability.
The numbers don't lie: LGBTQ+ youth are overrepresented in foster care, facing rates twice as high as their peers. And if you're a transgender or non-binary youth, these figures shoot even higher.
Tackling challenges faced by LGBTQ+ youth in foster care
The reality? LGBTQ+ youth in foster care often endure more mistreatment than those who aren't. From harassment and discrimination, especially in group homes, these youths face more hostile environments. What's more heartbreaking, they're more likely than their peers outside foster care systems, attempting suicide.
But this isn't just about youth. The bill also looks at how LGBTQ+ adults who want nothing more than a family face biases when adopting. This bias shrinks options and homes available despite statistics showing that same-sex couples are seven times likelier than their straight counterparts in considering fostering or adoption.
Lawmaker voices call out needful reforms
Angie Craig, Congress's first openly lesbian mom, speaks from experience about facing hurdles in adoption processes. She candidly shared her court battles ensuring she could adopt her son and says she's seen widespread discrimination firsthand.
Craig feels a deep sense in ensuring bias against LGBTQ+ foster kids and parents comes under fire. She takes pride in honoring John Lewis' legacy through this legislation, confirming every specter involved in adoption or fostering gets treated with deserved dignity and respect.
Senator Gillibrand mirrors these views, slamming discriminatory actions that deny safe homes based on prejudice. She emphasizes how this legislation, by blocking taxpayer-funded agencies from discriminating against children or would-be parents, strengthens protections around our most vulnerable.

Today, 15 states allow child welfare groups claiming religious beliefs as grounds can discriminate against LGBTQ+ youth and families, though some only extend this option when state funding isn't involved.
