Recently, Attorney General Pam Bondi's memo has ignited a fierce national debate about gender-affirming care provided, or potentially provided, in some cases, particularly when it comes involving minors. Bondi, who's had a history with opposition toward LGBTQ+ rights, has directed her Department's Justice Department (DOJ) team and staffers, demanding them them and plans and urging them strongly consider investigating and even looking at potentially pursuing prosecution, hard as that might be, in cases where minors are receiving gender-affirming care, saying this, in her view, amounts, somehow, and even equating this, controversially, no doubt, with female genital mutilation (FGM).
In her directive, Bondi didn't hold back: "The Department Department will not, under my watch, stand by while doctors, driven by ideology, profits, or perhaps both, exploit and harm our children." She hammered home her point, stressing, "Under my leadership, we'll take decisive action, you can count on that, and this action will protect our children and ensure that those who harm them under this 'guise' they claim as care, are held accountable.”
Bondi's memo sends a pretty strong warning shot, complete with threats severe legal consequences, targeting medical practitioners: we're talking up 10 years in prison if you're caught performing what she's calling FGM on anyone under 18. “Medical practitioners, hospitals, and clinics be warned, straight up: In this country, it counts as a felony if you perform, attempt, or conspire commit female genital mutilation on minors," Bondi announced, broadening her definition wide enough broad enough now include gender-affirming care and having some people up in arms.
It needs some serious clarifying: in reality, gender-affirming genital surgeries don't happen on minors here in across in U.S. Plus, under federal law, FGM, legally speaking, means "partial or total removal external female genitalia or injuries female genital organs, all this done all without a valid medical reason.” Bondi's memo mixes up these practices pretty significantly, which experts, both legal, and medical, are really concerned about this.
Bondi's gone further, targeting "on- or off-label use puberty blockers, sex hormones, or any drug used in facilitating a child undergoing ‘gender transition'" as possibly violating consumer protection laws. She also directed her DOJ's Civil Division's Fraud Section look closely at puberty blockers, alleging some hospitals Medicaid overbilling procedures these procedures.
Gender-affirming care gets big-time support from all major medical associations across United States, like American Medical Association, Endocrine Society, and American Academy Pediatrics. These groups say this care's not just safe, but often really important essential particularly young people dealing with gender dysphoria. They believe that without access gender-affirming care, risk mental health issues goes up significantly.
Robin Marill, a Constitutional Law professor at Willametet University, pointed out Bondi's memo doesn't set down any new laws. "From what I see, this all about showing how they'll allocate resources, conduct investigations," Marill explained. "This isn't some big law change. The goal seems more about intimidating physicians, maybe stopping necessary care, worrying it'll get slapped labeled ‘chemical, surgical mutilation' children."
Bondi's memo comes on heels contentious executive order from president last January, trying prohibiting gender-affirming care. But courts have blocked order's implementation, saying president can't enforce ban like this without Congress on board. Despite repeated efforts, Congress hasn't brought about a federal ban gender-affirming care.
Bondi also recently convened administration's "anti-Christian bias" task force, accusing President Joe Biden, yes, practicing Catholic, targeting Christians, citing FBI memo regarding threats anti-choice protestors.
As debates around gender-affirming care continue, LGBTQ+ community remains vigilant. Advocates keep stressing that it isn't legality at stake; it's about making sure that essential, life-affirming healthcare remains accessible transgender youth.
