Diana Adams, a lawyer specializing in non-traditional family structures, notes, "The landscape of what constitutes a family is evolving, and polyamorous relationships are becoming an integral part of this change." Adams highlights that while polyamory is gaining social acceptance, it still faces significant legal hurdles.
Despite their commitment, polyamorous partners like Cam, Bryan, and Tristan face legal challenges. For instance, if Tristan were hospitalized, Cam and Bryan might be denied visitation rights due to a lack of legal recognition. Similarly, they can't share health insurance benefits, and property rights remain a complex issue.
The legal system does not currently recognize relationships involving more than two partners as a protected class, unlike race or gender. This lack of recognition can lead to discrimination in areas such as housing, healthcare, and parental rights.
However, there have been some breakthroughs. In 2022, a landmark case in New York City recognized the rights of polyamorous partners in an eviction case. Cities like Somerville, Cambridge, and Berkeley have also implemented policies that offer limited legal recognition to polyamorous relationships, akin to domestic partnerships.
While state and federal laws do not yet provide comprehensive protections, polyamorous partners are finding creative ways to secure their rights. Forming a limited liability company (LLC) allows partners to jointly own property, share health benefits, and file taxes together, though it requires engaging in a commercial activity.
Legal experts recommend drafting wills, cohabitation agreements, and healthcare proxies to ensure partners can make decisions and inherit property. "It's about using existing legal frameworks to our advantage," Adams explains.
Advocacy groups like the Polyamory Legal Advocacy Coalition (PLAC) are pushing for broader recognition. They argue that the freedom to structure relationships as one sees fit is a fundamental right. They draw parallels to the fight for same-sex marriage rights, emphasizing that legal recognition reduces discrimination and promotes equality.
As society continues to redefine family, the hope is that more jurisdictions will adopt policies protecting diverse relationships. Until then, proactive legal planning remains essential for those in polyamorous relationships.
For Cam, Bryan, and Tristan, their journey is about more than just legal rights; it's about living authentically and defining family on their terms. "Family," Adams concludes, "is about commitment and support, regardless of legal or biological ties."
