A parent who made inflammatory accusations against school officials has been served with a $20 million defamation lawsuit. Damon Gettier, a parent associated with the local school district, has been accused of making baseless claims of "grooming and abusing" children, which have now led to serious legal repercussions.
These events unfolded at a school board meeting on May 18, 2023, where Gettier expressed his anger over the inclusion of LGBTQ+ materials in the school curriculum. His accusations, fueled by earlier social media posts expressing disdain for the presence of gay people at the school, were directed towards staff members whom he accused of indoctrinating children with progressive ideologies.
During the meeting, Gettier launched into an impassioned speech, claiming, "What I’m here to talk about is the child abuse, grooming, conditioning, and indoctrination by sexual predators disguised as teachers and staff at Glen Cove Elementary." His remarks targeted specific staff members, asserting that they were involved in inappropriate conduct under the guise of education.
In response to these allegations, Glen Cove Elementary School Assistant Principal Tobie McPhail filed a defamation lawsuit, asserting that Gettier’s statements were false and damaging to her professional reputation. The lawsuit seeks $5 million in compensatory damages and an additional $5 million in punitive damages, reflecting the emotional distress and career harm McPhail claims to have suffered.
Gettier's outburst was reportedly triggered by discussions of transgender issues within the school, which he objected to being presented to his child. He complained about having to explain the concept of being transgender to his nine-year-old son, following the school's alleged encouragement of such discussions.
Further fueling his anger were the actions of a music teacher who decorated her classroom with rainbow symbols, and a school psychologist who wore an LGBTQ lanyard. Gettier expressed his displeasure with these displays, perceiving them as attempts to propagate "woke, progressive ideologies" rather than focusing on traditional subjects like reading, writing, and arithmetic.
His remarks, however, did not go unnoticed. The school board, responding to Gettier’s complaints, implemented a ban on rainbow decorations in the school. Additionally, they enforced Governor Glenn Youngkin's policies regarding transgender youth, which included controversial measures such as forced misgendering, deadnaming without parental consent, and allowing students to opt-out of shared spaces with trans peers.
The school community's response to Gettier’s allegations was mixed, with protestors gathering in solidarity with school staff and educators. Demonstrations in support of the school followed, with protestors holding signs expressing support for their teachers and embracing the rainbow as a symbol of inclusion.
These tensions led to a series of confrontational school board meetings in July and August, during which several individuals were arrested. Those who were arrested opposed the school board’s new policies, which they viewed as discriminatory towards LGBTQ+ students. Charges included trespassing and disruption of public meetings.
The lawsuit against Gettier underscores the broader debate over how LGBTQ+ topics are addressed in educational settings, as well as the balance between parental rights and inclusive educational practices. McPhail’s attorneys, John Fishwick and Daniel Martin, have expressed their commitment to pursuing justice for their client, highlighting her dedication to providing a safe and equitable educational environment for all students.
"We have great respect for her," the attorneys stated. "We look forward to moving ahead with her case and ensuring that false and harmful statements are addressed appropriately."
