Historic Win for LGBTQ+ Rights in Saint Lucia

In an unprecedented legal victory, the Eastern Caribbean Supreme Court has struck down Saint Lucia’s laws banning homosexuality. This historic decision marks a significant step forward for LGBTQ+ rights in the Caribbean, affirming the unconstitutionality of laws that have long oppressed the community.

"This decision is deeply personal," expressed Kenita Placide, the executive director of the Eastern Caribbean Alliance for Diversity and Equality (ECADE). "For many years, we’ve worked tirelessly to see the rights, lives, and dignity of LGBTQ+ persons in Saint Lucia and the OECS protected." ECADE, an LGBTQ+ organization in the Caribbean, has been at the forefront of challenging discriminatory laws across the region.

The ruling explicitly targets Saint Lucia’s "gross indecency" and "buggery" laws, specifically sections 132 and 133 of the Criminal Code, which criminalized consensual same-sex relations, even in private. The Eastern Caribbean Supreme Court declared these sections unconstitutional, ruling that they violated fundamental rights including privacy, life, liberty, security of the person, freedom of expression, and protection from discrimination based on sex.

Although these laws were rarely enforced, their existence perpetuated a culture of discrimination and fear. The Human Dignity Trust highlighted that merely having such provisions is a human rights violation, often leading to broader discrimination. As explained by Placide, "Today’s ruling is not just a win in the courts, it also represents a step towards justice for the many lives lost to violence simply for being themselves. It signals that our Caribbean can and must be a place where all people are free and equal under the law."

Saint Lucia, with a population nearing 200,000, is predominantly Christian. It's part of the Eastern Caribbean Supreme Court's jurisdiction, alongside Dominica, Grenada, Saint Kitts and Nevis, Saint Vincent and the Grenadines, and Antigua and Barbuda. In recent years, ECADE has been instrumental in launching multiple legal challenges against similar bans in these nations. Victories in 2022 saw Barbados, Antigua and Barbuda, and Saint Kitts and Nevis overturning their anti-LGBTQ+ laws, and by 2024, Dominica followed suit.

The wider impact of these rulings extends beyond the Caribbean. They resonate with global movements advocating for equal rights and protection under the law for LGBTQ+ individuals. "Human rights in the Eastern Caribbean continue to advance as the colonial legacies of these unconstitutional provisions continue to fall," wrote J’Moul Francis, Antigua and Barbuda’s Foreign Affairs Minister, on social media. He continued, "However, more still needs to be done across the region to ensure that progress is real, practical, and effective for LGBTQ+ individuals."

This decision is a beacon of hope and a rallying call for continued advocacy and activism. It underscores the need for vigilance in protecting rights and challenging outdated laws. The success in Saint Lucia may inspire similar efforts worldwide, particularly in regions where LGBTQ+ individuals continue to face legal and social discrimination.
