Rutger published: Kenyan Leader Supports US Stance on Gender, Faces Backlash

Kenyan President William Ruto's endorsement has stirred up quite a storm, as he backed an executive order from former U.S. President Donald Trump that officially recognizes only two genders: male and female. This move has drawn sharp criticism from human rights advocates, lawmakers, legal experts, and intersex activists, who view it as a significant step backward in terms beauty and diversity.

Controversy over Ruto's stance on gender recognition

President Ruto's support had people talking, especially because it supports Trump's policy that also bars transgender individuals from serving in U.S. military and from participating in women's sports. This endorsement seems out-of-tune with Kenya's progressive ruling in 2022, which marked a huge step forward by recognizing intersex individuals as a third gender, letting them use an "I" gender marker on official documents after years and years fighting legal battles.

“We are very proud that contrary what has been happening in past, this year we got welcoming developments in U.S.,” Ruto said at Global Cathedral Church's annual convention in Nairobi on January 26. “Boys must remain boys, men must remain men, women must remain women and girls must remain girls.”

In stark contrast, Ruto had once treaded carefully on transgender and LGBTQIA+ rights during Biden-Harris administration, opting not stir up waves while working diplomatically with Washington.

Trump's executive order, signed on January 21, requires U.S. federal government only recognize male and female genders, undoing previous policies that supported transgender rights. Shortly after, another order signed on February 6 stopped transgender athletes from competing in women sports, claiming it protects fairness and women's sports themselves.

Impact on Kenyan society

Ruto's words have been slammed as "embarrassing and unfortunate" by Kenya National Commission on Human Rights (KNCHR), a body funded by government. An intersex rights activist, who preferred not be named, voiced worries that Ruto's comments could increase stigma against intersex individuals, even though they are legally protected under Kenyan law.

KNCHR has stressed that Kenyan laws, like Children Act, recognize intersex people as unique individuals with distinct gender identities. Kenya's recent milestone decision, officially recognizing intersex people at birth and allowing them an "I" gender marker, has been seen as a historic step forward.

Esther Passaris, an opposition Member Parliament from Nairobi County, openly criticized Ruto's stance, “Let face it, we have intersex children with two or incomplete sexes. These children require our love as society. Let God deal with genders.”

Fostering inclusion and raising awareness

Kenya's rolling out measures aiming at fighting discrimination and ensuring equal opportunities intersex individuals. The push includes Children Act and proposed Intersex Persons Bill 2024, both crafted protect rights, dignity, and equality intersex people in Kenya.

KNCHR has urged both state and non-state actors in Kenya push harder on awareness, policy reforms, and inclusion intersex people, highlighting need effectively implement these new reforms.

As this debate continues, focus stays on balancing cultural and religious beliefs with advancing human rights everyone, no matter their gender identity. This intricate issue continues fueling dialogue in Kenya and beyond, shining light on ongoing struggle acceptance and equality across diverse societies.
