The U.S. Department of Justice (DOJ) has initiated an investigation into three school districts in Michigan: Lansing, Detroit Public Schools, and Godfrey-Lee Public Schools. The investigation seeks to determine whether these districts appropriately informed parents of their right to opt their children out of curriculum content concerning sexual orientation and gender identity in pre-K through 12th grade classes.
Assistant Attorney General Harmeet K. Dhillon emphasized the DOJ's dedication to scrutinizing educational policies that integrate discussions of sexuality and gender identity. In a statement, Dhillon declared, "The Department of Justice is fiercely committed to addressing the increasing trend of educational authorities embedding discussions of sexuality and gender ideology into public education."
This investigation follows the precedent set by the Supreme Court's decision in Mahmoud v. Taylor in 2025. This ruling established that parents have the right to exclude their children from curriculum content that acknowledges the existence of LGBTQ+ individuals, particularly if it conflicts with their religious beliefs. The court found that the use of educational materials featuring LGBTQ+ characters could infringe upon some parents' First Amendment rights to direct the religious education of their children.
The decision sparked controversy, with free speech and LGBTQ+ advocates criticizing it for potentially allowing families to exempt their children from a broad range of educational topics that may not align with their personal beliefs, from environmental education to programs on critical thinking and drug prevention.
Dhillon's statement also touched on the implications of Title IX, a federal law prohibiting sex-based discrimination in education. She stressed the importance of safeguarding students' rights to access single-sex facilities based on their biological sex, while the DOJ considers whether the districts’ policies are inclusive of transgender students.
Under the previous administration, Title IX was interpreted as precluding discrimination against transgender individuals by acknowledging the interplay of sex and gender identity. The current DOJ, however, appears to be re-evaluating this interpretation, suggesting that certain trans-inclusive policies might impinge on the privacy rights of cisgender students.
Dhillon hinted that the administration might withhold federal educational funding if schools are found to be in violation of Title IX or the precedent set by Mahmoud v. Taylor.
