The International Criminal Court (ICC) is taking significant legal action against senior members of the Taliban, targeting them for gender-based persecution, including acts against LGBTQ+ individuals in Afghanistan. In a recent announcement, ICC Prosecutor Karim A. A. Khan outlined the charges being laid against two high-ranking Taliban officials.
On January 23, the ICC Prosecutor publicly shared that his office, after a thorough investigation into alleged crimes against Afghan civilians, has found substantial reasons to believe that the Taliban’s Supreme Leader, Haibatullah Akhunzada, and the Chief Justice of the so-called 'Islamic Emirate of Afghanistan,' Abdul Hakim Haqqani, are criminally responsible for persecution based on gender. This falls under the crime against humanity as defined by Article 7(1)(h) of the Rome Statute, the foundational treaty of the ICC established in 1998.
This move by the ICC is groundbreaking, marking the first occasion the court has formally recognized crimes against the LGBTQ+ community. As Artemis Akbary, Executive Director of the Afghanistan LGBTIQ Organization, stated, this is an unprecedented moment in international justice which acknowledges the dire plight of LGBTQ+ people under Taliban rule.
The ICC’s actions come amidst numerous reports and appeals from LGBTQ+ Afghan activists who have been urging international bodies to acknowledge and act against the systemic and widespread human rights violations they face. Many have criticized entities like the United Nations for remaining silent in the face of what is described as a severe humanitarian crisis.
Since the Taliban’s return to power after the U.S. military withdrawal in 2021, there has been a noted regression to strict interpretations of Sharia law. According to Khan, such laws should not be exploited to violate fundamental human rights. The ICC's investigation highlights severe abuses such as violations of the right to physical integrity, freedom of movement, expression, and the right to private life and assembly.
Additionally, these abuses are connected to other grave crimes under the Rome Statute, including murder, imprisonment, torture, sexual violence, enforced disappearances, and other inhumane acts. Human Rights Watch and other organizations document that violence against LGBTQ+ individuals has escalated in recent years, with systematic attacks against gay men and transgender women becoming alarmingly common.
In October 2023, Rainbow Afghanistan, a local LGBTQ+ rights group, published a detailed account of the extreme abuses faced by queer individuals since the Taliban's resurgence. The group reported instances of torture, stoning, forced marriages, and sexual assault. Alarmingly, many LGBTQ+ people have resorted to suicide due to the unbearable conditions. The group has called for urgent intervention from the United Nations and global human rights entities.
Akbary emphasized the importance of the ICC’s arrest warrant application as a vital statement from the international community against the persecution of LGBTQ+ individuals. He stressed the need for continued support and solidarity to ensure justice and accountability for those affected.
ICC judges are now tasked with deciding whether to issue arrest warrants for Akhunzada and Haqqani. If the warrants are granted, Prosecutor Khan assured that his office, in collaboration with ICC Registrar Osvaldo Zavala Glier, would pursue justice rigorously.
Human Rights Watch has acknowledged that this legal maneuver brings the Taliban’s consistent oppression of women, girls, and gender non-conforming individuals back into the global spotlight. Liz Evenson, Director of International Justice at Human Rights Watch, noted that with limited justice prospects within Afghanistan, the ICC’s warrant requests are crucial for holding perpetrators accountable.
The Executive Director of ILGA World, Julia Ehrt, hailed the ICC’s recognition of LGBTQ+ victims as a significant step in international jurisprudence.
