Justice Venkata Jyothirmai Pratap, who presided over this case, stated that defining women just by their ability or capacity towards pregnancy isn't legally sustainable and clashes with India's Constitution. Articles 14, 15, and 21 guarantee nondiscrimination and support rights such as life and personal liberty. Thus, trans women gaining legal recognition as women outweighs any narrow legal interpretations.
This case began in 2022, initiated by Pokala Shabana, a trans woman seeking legal protection from her in-laws under Section 498A, which protects women from cruelty by a husband or his relatives. Shabana faced opposition from her husband's family, who argued such protections should only apply if "cisgender" status was confirmed, given trans women didn't have legal recognition.
The High Court rejected these arguments, stating that not allowing trans women legal status as women constitutes discrimination. Justice Pratap anchored this decision with a landmark Supreme Court ruling from 2014, acknowledging rights held by those identifying as a "third gender."
The judgment has brought joy and relief among transgender activists and supporters nationwide. Noted trans activist and artist Kalki Subramani, hailed it saying, "This verdict means everything. It confirms our basic human right—the right towards self-identification."
