This case began through Shieys Chepkosgei, a trans woman who faced alarming injustices. In 2019, Chepkosgei was arrested and charged with "impersonation," even though she possessed valid documents, including a birth certificate and passport, affirming her gender as female. These documents were obtained in another country where she also participated in women's sports.
Chepkosgei's struggles intensified when she was detained by Kenyan police while at a teaching hospital. She found herself in a women's detention facility, subjected her restrictions on her rights. The court even ordered her through a demeaning "gender determination" process, which included intrusive medical exams and other tests.
