GLAAD Challenges Trump’s Executive Order on Transgender Athletes
In a recent development that has sparked significant controversy, GLAAD (Gay & Lesbian Alliance Against Defamation) has spoken out against a new executive order signed by former President Donald Trump. This order, aimed at excluding transgender women from participating in women's sports, has been labeled by GLAAD as having “zero credibility” when it comes to the protection of women and girls.
On February 5th, President Trump followed through on a campaign promise by signing an executive order intended to prevent transgender women from competing in women’s sporting events. The order outlines guidance, regulations, and legal interpretations while also mandating the Department of Education to scrutinize high schools suspected of non-compliance.
This directive, titled “Keeping Men Out of Women’s Sports,” was signed on National Girls and Women in Sports Day. It took immediate effect and impacts high school, university, and grassroots sports competitions. The order claims that the participation of transgender women and girls in female sports is detrimental, asserting it is “demeaning, unfair, and dangerous to women and girls,” and purportedly denies them equal opportunities in competitive sports.
GLAAD, a leading LGBTQ+ media advocacy organization, has criticized the order, stating it is more of a smear against a group of Americans rather than a change in law or facts. They emphasized that all women and girls, including transgender individuals, should have the opportunity to participate in sports, make personal decisions about their bodies, secure employment for which they are qualified, and live free from unwarranted legal attacks.
The statement from GLAAD pointedly remarked that “anti-LGBTQ politicians… have zero credibility in any conversation about protecting women and girls.” They called on all Americans to demand that leaders cease targeting vulnerable populations and focus on addressing genuine issues facing the nation.
The executive order invoked Title IX, a pivotal piece of civil rights legislation enacted in 1972, which prohibits sex-based discrimination in educational programs or activities receiving federal funding. Title IX is renowned for advancing gender equality in college sports. However, the scope of Title IX, especially regarding transgender inclusion in sports, has become a hotly debated topic.
In recent years, especially following the Biden administration’s 2022 proposed update to Title IX to include explicit protections for LGBTQ+ students and prohibit discrimination based on sexual orientation and gender identity, the interpretation of this law has faced considerable scrutiny. The update was met with opposition from several Republican-led states, which vowed to reject the law. They argued that the changes were “illegal, undemocratic and divorced from reality” and claimed the legislation endangered women, leading to legal battles that are ongoing.
In August 2024, the US Supreme Court declared that the revised definitions of Title IX cannot be enforced in 26 states embroiled in these legal disputes.
Earlier this year, Republicans made attempts to redefine Title IX protections to be exclusively based on biological sex in their legislative agenda for the 119th Congress. South Carolina representative Nancy Mace, known for initiating the trans bathroom ban at the US Capitol, had previously commented on Trump’s executive order. She stated that it “restores fairness, upholds Title IX’s original intent, and defends the rights of female athletes who have spent their lives striving to compete at the highest levels.”
