For example, if a hysterectomy is covered for cisgender women, the same coverage must be provided for transgender men.
Judge Guirola's ruling, however, leaned on an "originalist" interpretation of Title IX, arguing that the term "sex" should be understood as it was at the time of the statute's passage in 1972, defined strictly in terms of biological distinctions between male and female.
