EU Court Rules Against Hungary's Anti-LGBTQ Legislation

The European Union's Court of Justice has annulled Hungary's anti-LGBTQ law, marking a significant victory for LGBTQ rights across Europe. This decision comes as a triumph not only for the LGBTQ community in Hungary but also for those across the continent who have been advocating for equality and human rights.


In 2021, Hungarian lawmakers passed Act LXXIX, which imposed stringent restrictions on content accessible to individuals under 18, especially those depicting sexuality diverging from traditional norms. It specifically targeted any content portraying homosexuality, gender reassignment, or any deviation from one's birth-assigned gender identity.


The European Commission, backed by sixteen EU member states including Austria, Belgium, Denmark, and others, brought the case against Hungary. The European Parliament also stood in opposition to the law. Hungary's former Prime Minister Viktor Orbán had staunchly defended the legislation, citing national identity and cultural standards as justifications.


The EU Court of Justice, after thorough deliberation, concluded in 2024 that Hungary's law breached EU principles. A press release accompanying the decision highlighted that Hungary had violated Article 2 of the Treaty on European Union. This article enshrines the EU's foundational values such as human dignity, equality, and human rights, especially the rights of minority groups.


The court's analysis revealed that Hungary's legislative measures constituted a coordinated and severe breach of the rights of non-cisgender and non-heterosexual individuals. The court asserted that such measures are incompatible with the EU's identity as a bastion of pluralism and legal unity.


Hungary's reliance on national identity as a defense was dismissed by the court, as it contravened the collective values and commitments of EU member states.


The ruling has been celebrated by the Háttér Society, a prominent Hungarian organization advocating for LGBTQ rights. They hailed the court's decision as a pivotal moment for human rights within the EU and a historic victory for the LGBTQ community in Hungary.


This legal showdown occurred shortly after Viktor Orbán's defeat in the Hungarian elections by Péter Magyar. Orbán, who came to power in 2010, had been criticized for his government's broader crackdown on LGBTQ rights, including bans on Pride and other public LGBTQ gatherings. Despite the government's stance, significant numbers of individuals participated in Budapest's annual Pride parade, defying prohibitions.


The court emphasized that Hungary's legislative changes significantly infringed on fundamental rights protected by the EU Charter of Fundamental Rights, particularly the prohibition on sex-based discrimination.


Financially, Hungary has faced repercussions under Orbán's leadership, with the EU withholding over €35 billion in funds due to concerns over corruption and the rule of law. Péter Magyar has expressed intent to collaborate with the EU to restore these funds.


In response to the court's ruling, ILGA-Europe's Deputy Director Katrin Hugendubel urged Magyar's administration to revoke the anti-LGBTQ law, emphasizing the importance of this action in Hungary's new EU-aligned direction.


"With this ruling, the EU Court of Justice confirms what has been known for years," stated Hugendubel. "There is no longer any excuse for the Commission not to demand the swift repeal of this law. As Hungary steps into a new era, repealing such legislation, including the Pride ban, must be a priority."


Hugendubel further emphasized that if Péter Magyar truly seeks to align Hungary with EU values, repealing the law should be a top priority in his initial 100 days in office.


The EU court's ruling marks a defining moment for LGBTQ rights in Hungary and sets a precedent for upholding human rights across the European Union.
