Dubbed "Keeping Men Out of Women's Sports," the executive order fulfills a campaign promise made by Trump. Organizations such as GLAAD have criticized the order, arguing that it lacks any legitimate basis for protecting women and girls. The order specifically bans transgender women from competing in women’s sports, igniting widespread debate and controversy.
Following the signing of the executive order, the Department of Education now possesses the authority to examine high schools and sports governing bodies suspected of non-compliance with the order. Investigations under Title IX have begun against the California Interscholastic Federation and the Minnesota State High School League after these bodies announced their commitment to enabling transgender students to compete according to their affirmed gender identity, rather than their sex assigned at birth.
These organizations maintain that they are adhering to state anti-discrimination laws. However, a spokesperson for the Trump-Vance administration has asserted that the executive order takes precedence over state legislation.
On Wednesday (February 12), Craig Trainor, the acting assistant secretary for civil rights at the Department of Education, stated, "The Minnesota State High School League and the California Interscholastic Federation are free to engage in all the meaningless virtue-signaling that they want, but at the end of the day they must abide by federal law."
Title IX, a pivotal civil rights law enacted in 1972, explicitly prohibits sex-based discrimination in educational programs and activities receiving federal funding. While historically known for promoting gender equality in collegiate sports, the law's interpretation has become a contentious issue concerning transgender inclusion in sports.
