Rutger published: Denmark Issues Travel Advisory for Transgender Individuals Visiting the U.S.

In a growing trend among European nations, Denmark has issued a travel advisory for transgender individuals planning to visit the United States. This advisory follows similar actions taken by Germany and Finland and highlights concerns over recent U.S. policies affecting transgender and nonbinary travelers.

The advisory, released by the Danish Foreign Affairs Ministry, draws attention to the limited gender options available when applying for an Electronic System for Travel Authorization (ESTA) or a U.S. visa. "When applying for an ESTA or visa to the United States, there are two gender designations to choose from: Male or female," the advisory notes. "If you have the gender designation 'X' in your passport, or you have changed your gender, it is recommended that you contact the U.S. Embassy prior to travel for guidance on how to proceed."

These advisories have been partly in response to actions by the U.S. government under President Donald Trump's administration. Shortly after taking office, President Trump issued an executive order that prevents the State Department from issuing passports with an 'X' gender marker. Following this, Secretary of State Marco Rubio instructed State Department personnel to suspend applications requesting an 'X' sex marker, pending further guidance.

Further escalating concerns, a subsequent executive order issued on February 5 bans transgender women and girls from participating in female sports teams. American consular officials have been directed to deny visas in cases where applicants are suspected of misrepresenting their purpose of travel or sex, according to reports.

This stance has led to increased scrutiny and advisories from international organizations and governments. Earlier this month, the German government issued a similar advisory, urging caution for trans and nonbinary individuals traveling to the U.S. Finland followed suit, indicating a regional consensus on the risks posed by current U.S. policies.

The Impact on WorldPride 2023

WorldPride, a significant global event celebrating LGBTQ+ pride, is scheduled to take place in Washington, D.C., from May 17 to June 8. However, the current U.S. policies have sparked concerns over the participation of transgender and nonbinary individuals.

InterPride, the global organization coordinating WorldPride, has also issued a travel advisory for those planning to travel to the U.S. for the event. The advisory notes, "Due to an executive order issued by the U.S. president on Jan. 20, all travelers must select either 'male' or 'female' when applying for entry or visas. The gender listed at birth will be considered valid." Travelers with passports marked 'X' or those whose gender differs from their birth-assigned gender are strongly advised to contact U.S. diplomatic missions to clarify entry requirements.

The Capital Pride Alliance, the local host for WorldPride, has acknowledged the challenges posed by these policies. They are currently working on a guideline to assist travelers in navigating these requirements, although the guide has not yet been released.

Calls for Boycotts and Community Responses

In response to these developments, some advocacy groups are calling for actions against WorldPride in the U.S. The African Human Rights Coalition has urged a boycott of the event, citing the "antagonistic fascist regime which presents distinct dangers to foreign LGBTQI+ attendees" currently governing the U.S.

Egale Canada, a prominent LGBTQ advocacy organization, announced in February that its members will not attend WorldPride or any other events in the U.S. This decision reflects growing discontent and concern over the Trump-Vance administration's policies regarding LGBTQ rights.

As the situation develops, international travelers and communities continue to navigate the complex landscape of policies affecting transgender and nonbinary individuals. These travel advisories serve as a critical tool in raising awareness and providing necessary guidance for those affected by these policies.

As WorldPride draws closer, the international LGBTQ+ community remains vigilant, seeking to ensure safety and inclusivity for all participants. The impact of these advisories and the broader political landscape in the U.S. will likely continue to influence global discussions on LGBTQ+ rights and travel.
