Texas Faces Scrutiny Over Transgender Data Collection Practices
In recent developments, the state of Texas has come under fire for its controversial policy of maintaining a list of transgender individuals who seek changes to their driver’s licenses. This policy has raised significant concerns among LGBTQ+ advocates and civil rights organizations, with many questioning the rationale behind such data collection.
Back in August, Texas implemented a ban preventing drivers from adjusting the gender markers on their licenses to reflect their gender identity. The move was met with widespread criticism, and new findings have brought to light that employees at the Department of Public Safety (DPS) are actively documenting all requests by transgender drivers, storing this sensitive information in a state-managed database.
According to documentation obtained by reporters, at least 42 attempts to modify driver’s license information were recorded over a five-month period. These attempts included various forms of communication such as phone calls, in-person visits, and emails, where individuals sought guidance on state policies.
The records indicate that DPS staff systematically scanned and saved the information of transgender individuals seeking license changes, and forwarded this data to an internal email account designated for such matters.
Despite repeated inquiries, officials at the DPS and the Texas Attorney General’s office have not provided clear answers regarding the purpose of this data collection, the entities with whom the information is shared, or whether the process is still active.
The way these requests are handled also varies. While some employees permit name changes on licenses, requests to update gender markers are often denied. In certain cases, new residents with out-of-state or federal documents reflecting their gender identity were still unable to secure a matching Texas license or ID.
Texas Attorney General Ken Paxton has publicly denounced court orders that direct state agencies to amend gender markers, labeling them as "illegal." This stance has further fueled tensions and contributed to the distrust between the transgender community and state authorities.
The controversy escalated when screenshots of the DPS’s trans data collection email address surfaced online, leading to a deluge of spam from individuals protesting the policy. Among the 700 pages of emails reviewed by reporters, most were spam messages aiming to disrupt the communication channel, with only a handful being legitimate requests for gender marker changes.
The email address, inundated with unsolicited content, received subscriptions to various newsletters, including those from advocacy groups and commercial entities. These actions were a form of protest against what many view as an invasive and discriminatory policy.
Critics have labeled the state’s actions as “evil,” “fascistic,” and reminiscent of totalitarian regimes. The policy’s implementation has sparked a debate about the rights of transgender individuals and governmental overreach.
Despite mounting criticism, internal documents reveal that DPS employees persisted in gathering data and forwarding it internally, even after the initial wave of public outcry.
Texas Attorney General Ken Paxton has doubled down on his position, asserting that it is illegal for transgender Texans to alter the gender listed on their state-issued identification. He further stated that any previously modified documents must be reverted to their original state, though no specific law currently mandates such actions.
Earlier this year, legislation was proposed in the Texas Legislature that would impose severe penalties, including imprisonment, on individuals whose gender markers on state documents do not align with their gender at birth.
This ongoing issue highlights the broader challenges faced by the LGBTQ+ community in Texas and underscores the importance of vigilance and advocacy in protecting the rights of all individuals, regardless of gender identity.
