The Trump administration has sparked some buzz by asking investigators from their own Department Department (DOJ) service investigations on Judge Ana Reyes, a well-known federal judge who identifies as lesbian. They're raising red flags about her alleged bias during a courtroom exchange about Trump's policy that blocks transgender folks from joining or staying in military service.
Chase Mizelle, who serves as Chief Head Staff at DOJ, formally complained against Judge Reyes with Chief Judge Sri Srinivas at Washington's D.C. Circuit Court appeals. Since he was appointed by President Obama, Srinivas finds himself in a tricky place, as he's got two choices: either toss out these charges or start digging deeper.
In this formal complaint, Mizelle claims Judge Reyes crossed a boundary by going on with "hostile and extreme behavior" when questioning DOJ's own lawyer, Jason Lynch. He says that her actions undermined judicial decorum and showed a clear bias.
One sticky point in this situation came up when Reyes asked Lynch how Jesus might feel about discrimination against transgender people, which Mizelle argues was off-topic and put Lynch in a tough spot.
The complaint adds more fuel by accusing Reyes' use Lynch as a "prop" during a courtroom demonstration about prejudice, commonly known as animus—an act that allegedly embarrassed Lynch in front as an audience watching from raised gallery seats.
Reyes didn't hold back her sharp criticism on Trump administration's choice words in their transgender ban order—she described them as disrespectful, labeling transgender folks as dishonorable and selfish. She wasn't afraid asking if such language reflected prejudice.
Taking things further, Reyes also took issue with Administration officials enforcing narrow standards, pointing out gender identity doesn't neatly fit “male or female.” This just added fuel fire with accusations heading her direction from DOJ.
During one heated moment, Reyes threw another curveball asking Lynch, “What would Jesus say about telling people they're worthless enough not getting access basic shelter?” Mizelle slammed this interaction saying such language put Lynch between rock, hard place—slang usage tipped overlines professionalism.
Mizelle urged Srinivas take appropriate steps ensuring courtroom maintain respect impartial proceedings. His complaint argues Reyes actions eroded her respect towards courtroom counsel while making intimidating atmosphere.
