Utah's legislature, predominantly led by Republicans, has passed a controversial bill that would prevent transgender students from residing in dormitories that align with their gender identity. This legislation, House Bill 269, is set to return to the House of Representatives for a final concurrence on an amendment before being presented to Governor Spencer Cox, who is anticipated to sign it into law.
House Bill 269, introduced by Rep. Stephanie Gricius, is being justified by its proponents as a measure to protect privacy. It mandates that students at public colleges and universities must use gendered spaces based on their sex assigned at birth. This includes dormitories, locker rooms, and bathrooms.
The bill was brought forward following an incident at Utah State University involving a transgender resident assistant, Marcie Robertson. A fellow student, Avery Saltzman, expressed discomfort upon discovering Robertson's gender identity. This reaction was publicly echoed by Saltzman’s mother, Cheryl, who criticized the university for not informing them about Robertson's transgender identity. In response, Republican leaders in the legislature vowed to address the issue legislatively.
McKinsey Robertson, Marcie's mother, recounted the initial excitement her daughter felt about assuming the role of an RA, only to have those feelings replaced by fear due to threats she received following the incident. "I am appalled at the writers of this bill for holding the safety of other girls over the safety of mine," she said, highlighting the personal toll the situation has taken on her family.
The bill has sparked significant debate within the state legislature. Rep. Sarah Hayes, the only openly LGBTQ+ lawmaker in Utah, defended Robertson during the discussions, arguing that Marcie's privacy has been more infringed upon than anyone else's.
Despite the Republican majority, not all party members support the bill. State Sen. Daniel Thatcher was the sole Republican to vote against the bill, expressing shame towards his colleagues for targeting vulnerable populations with such legislation.
In contrast, State Sen. David Hinkins drew a controversial analogy by comparing being transgender to violating campus rules, such as possessing alcohol, suggesting that non-conformity to social norms should equate to forfeiting campus housing privileges.
As the bill awaits the governor's decision, it has attracted criticism from civil rights organizations, including the American Civil Liberties Union (ACLU). The ACLU has urged Governor Cox to veto the bill, arguing that it unfairly relegates transgender students to gender-neutral or single-occupancy dorms, which are not available at all public colleges in Utah. They warn that this could effectively exclude transgender students from campus housing.
Furthermore, the ACLU warns that even if such housing were made available, it would foster a separate and unequal environment, isolating transgender students rather than integrating them.
Governor Cox has previously been embroiled in controversies related to misinformation about trans issues, casting doubt on his commitment to equitable treatment of transgender individuals.
The outcome of this bill carries significant implications not only for transgender students in Utah but also as a reflection of broader societal debates on gender identity and equality. The decision now rests with Governor Cox, who must weigh the potential social repercussions of enacting such a divisive measure.
