Conservative lawmakers and activists are increasingly vocal about their desire to challenge and overturn same-sex marriage rights in the United States. Key figures such as Oklahoma state Rep. David Bullard and Mat Staver, the founder and chairperson of the anti-LGBTQ+ legal organization, the Liberty Counsel, have made statements indicating that they believe the time is right for Republicans to pressure the courts into reconsidering the landmark 2015 Supreme Court decision, Obergefell v. Hodges, which legalized same-sex marriage nationwide.
Bullard has introduced a controversial bill, S.B. 309, which aims to provide a $2,000 tax credit per child, but only extends this benefit to married couples with biological children conceived during the marriage. This exclusionary policy would leave out families who adopt, use reproductive assistance such as sperm or egg donors, and notably, LGBTQ+ couples. This proposal has been criticized by advocacy groups and legal experts who argue that it discriminates against non-traditional families.
In a recent conversation with Jenna Ellis, a former lawyer to President Donald Trump, Bullard expressed his belief that now is the time to "push back" against the Obergefell ruling. He stated his objective to challenge the concept that the Constitution protects the rights of same-sex marriages, framing his legislative efforts as a defense of his own freedoms of speech, expression, and religion. Ellis, who has faced legal issues for her role in attempting to overturn the 2020 presidential election, echoed Bullard's sentiments, claiming that the ruling has negatively impacted children and religious freedoms.
Additionally, Bullard is known for his history of proposing legislation that many see as targeting the LGBTQ+ community, such as attempts to eliminate public recognition of Pride Month and forcing school counselors to out LGBTQ+ students to their parents. Meanwhile, Mat Staver appeared on the World Prayer Network, declaring that the opportunity to overturn marriage rights is "ripe." He asserted that there is no constitutional basis for same-sex marriage and confidently predicted that Obergefell will be overturned in the future.
The current composition of the Supreme Court, with a 6-to-3 conservative majority, has fueled concerns that a case challenging Obergefell could potentially succeed. Supreme Court Justices Clarence Thomas and Samuel Alito have previously expressed interest in revisiting the legal rationale of the 2015 decision. To bring a case before the Supreme Court, it must first progress through the lower courts and receive agreement from at least four Justices to be heard.
Opponents of same-sex marriage argue that it imposes on religious freedoms and traditional definitions of marriage. However, legal experts highlight that the Constitution's equal protection and due process clauses mandate equal treatment under the law, regardless of sexual orientation, unless a significant government interest justifies otherwise.
The potential reversal of Obergefell could lead to a patchwork of marriage laws across the country. Currently, 25 states have laws or amendments banning same-sex marriage, though these are unenforceable under the current Supreme Court ruling. The 2022 Respect for Marriage Act requires recognition of legal same-sex marriages nationwide, but a repeal of this federal law could revert the country to a pre-2015 state where marriage legality varies by state, complicating the lives of same-sex couples and their families.
