Rutger published: Concerns Arise Over Potential Misuse of Social Security Data

Two individuals within the Social Security Administration (SSA) have expressed serious concerns about the recent access to personal Social Security information by billionaire Elon Musk and his associates from the newly established Department of Government Efficiency (DOGE). These insiders fear that the data access could potentially enable the current administration to identify and target transgender Americans.

According to legal documents, DOGE representatives Mike Russo and Akash Bobba visited the SSA on January 31 and gained access to detailed records on every person in the United States with a Social Security number. This data includes addresses, medical and employment histories, tax records, banking information, citizenship details, and family backgrounds. Such extensive access has raised alarms about privacy and the potential for misuse.

Legal Action and Court Orders

The American Federation of Labor and Congress of Industrial Organizations (AFL-CIO), one of the largest labor unions in the country, took legal action against DOGE's data access. Federal Judge Ellen Lipton Hollander subsequently ordered DOGE and Musk to cease accessing the SSA data and to delete any non-anonymized information they had obtained.

When questioned, government attorneys could not justify DOGE's need for such comprehensive access to private and sensitive information. DOGE claimed that the data was necessary to uncover instances of fraud and waste, but this assertion was challenged by experts in the case.

Expert Testimony and Security Concerns

Tiffany Flick, who has worked with the SSA for 30 years, described DOGE's request for the data as "unusual and improper." She highlighted that neither Russo nor Bobba possessed the necessary training or security clearances to handle the sensitive information. Flick pointed out that audits for theft and waste could be conducted without full access to the SSA's data sets.

Furthermore, Flick warned that DOGE's access left the data vulnerable to misuse by "bad actors," including foreign entities or government officials who might exploit the information to persecute political dissidents, journalists, and LGBTQ+ individuals.

Potential Implications for the Transgender Community

Transgender activist and researcher Zinnia Jones told Rolling Stone Magazine that the SSA data could be used to identify almost all transgender individuals in the U.S. with over 99% accuracy. This is because the 2015 U.S. Census Bureau used similar SSA data to estimate the transgender population.

Concerns also extend to the possibility of identifying and removing transgender employees from government positions. An anonymous current SSA employee voiced worries about the data being used to intimidate medical providers offering gender-affirming care, a type of healthcare that the current administration opposes.

Broader Implications for Privacy and Civil Rights

These events occur against a backdrop of increasing government surveillance of LGBTQ+ communities. Recently, the Department of Homeland Security amended its policies to permit surveillance of LGBTQ+ groups, labeling them potential threats to national security. This shift was implemented under the DHS Office of Intelligence and Analysis, an office with a history of civil liberties violations.

In response to the court's directive halting DOGE's access, SSA acting commissioner Leland Dudek considered restricting all employee access to the data, asserting, "Really, I want to turn it off and let the courts figure out how they want to run a federal agency." However, Dudek later clarified his stance, noting that the court had issued further instructions.

These developments underscore the ongoing tension between data security and government oversight, particularly concerning the rights and privacy of marginalized communities.
